A University of Toledo law graduate is responsible for filing this lawsuit ...

Steven Marquis, a resident of Fall City, Wash., a town about 30 miles southeast of Seattle, has filed a lawsuit against Washington Secretary of State Sam Reed, demanding that Mr. Reed verify Mr. Obama's citizenship status. The complaint seeks specifically that the office of the Washington Secretary of State verify and certify that Mr. Obama is or is not a "natural born" citizen by producing original or certified verifiable official documents. The lawsuit argues that this certification should take place before the election to preclude a constitutional crisis ...

Another intervening motion was filed today in the ongoing federal suit against Barack Obama. This motion, filed pro se by "U.S. Citizen and voter" Judson Witham of Provo, Utah, is the third such motion for leave to intervene filed in this case.   When API asked Mrs Obama to comment on why Dr Corsi was arrested by the Kenyan government and whether she thought Kenya's Prime Minister Mr Raila Odinga was involved in Dr Corsi's arrest, she got irritated and and simply told API not to dig that which will support evil people who are out to stop her husband from getting the presidency
  On Farakhan and his ministry, Mrs Obama told API that it was unfortunate that Mr Farakhan came out the way he did supporting her husband openly before the elections was over. That was not wholehearted support but one that was calculated to convince the American people that my husband will support the growth of muslim faith if he became the president, adding "even if my husband was able to prove that he is not a Muslim, he will not be believed by those who have come out strongly to destroy his chances of being the next President. Do real people expect someone to deny a religion when 80 percent of his relatives are Muslims?; Mrs Obama asked.

    Predictably, since we began reporting on this issue, The March Report has been deluged with hate mail from people who, based on their comments, obviously did not bother to read what has been reported here. The comments can be distilled into 3 categories: those who called us racists and/or anti-Muslim bigots (and other epithets we cannot print here), those who claim that the issue was settled when Obama allegedly produced his birth certificate, and those who claim McCain is not a citizen, having been born in Panama.
    Our rebuttals: 1) Robert Jay March is himself racially mixed; although it goes back several generations, he is part Oriental. He also has Muslim members of his extended family, including several whose surname is Hussein. 2) We disprove the legitimacy of the alleged birth certificate below. 3) Under the terms of the Acquisition Of U.S. Citizenship By Birth Abroad To U.S. Citizen Parent Act, McCain is legally a Natural born citizen, fully qualified to serve as President, as described below

But let's not forget that FactCheck is owned by the Annenberg Foundation, the same foundation that gave millions of dollars to Obama and his unrepentant terrorist pal William Ayers for an "education" project. To me, that makes FactCheck ipso facto the least credible source of factual information ...

The file linked here is the "Certificate of Live Birth" produced by the Obama Campaign, claiming he was born in Hawaii in 1961. Please note that the type on the certificate was created on an IBM Selectric Composer, technology which did not exist until 1976, and that, in the lower left corner of the certificate, the revision date of the form is listed as November of 2001. Also take note of the fact that the word used to identify the father's race is "African." While that is the word that would be used today, in 1961, the terminology used would have been "Negro" or "Colored." Compare this to a genuine Certificate of Live Birth from the period, below ...

     Today, we display Obama's Indonesian school registration, both the original and English translation, which declare him to be an Indonesian citizen of the Islamic faith. There is nothing wrong with being a Muslim; what's wrong is lying about it. There's nothing wrong with being an Indonesian citizen, but it does render you ineligible to serve as President of the United States.
     A few days ago, Senator Obama rushed off to Hawaii, ostensible to see his ailing grandmother. Yesterday, Hawaii's Gov. Linda Lingle sealed Obama's birth certificate. Hmmmm.

    When The March Report started getting tips on this a couple of weeks ago, I instantly thought "Dirty Tricks," but, as a responsible journalist, we had to check the allegations out. We were stunned to find how much evidence there was to prove this story, juxtaposed against NONE to disprove it.
    To those of you inclined to send hate mail without reading the stories first: the fact that you do not want to believe something is true does not make it a lie. Read the material we have presented over the last six issues, and evaluate it with an open mind. If you still think the story is untrue, then go ahead and send your hate mail.
    I don't mind hate mail at all -- it goes with the territory. I just object to geting mail of any kind from morons. Not one person on the other side of this issue has submitted a single point that we have not already refuted. "Guess what: McCain was born in Panama" is the most common one; we've already shown in Monday's issue the law that establishes McCain is a natural-born US citizen, because he was born on a US Naval Base in Panama, which is considered sovereign US territory for citizenship purposes. Legally, he is just as much a "natural born citizen" as someone born in Sheboygan, Wisconsin.
    The most hilarious of these bone-headed e-mails were sent as replies to Monday's newsletter, which contained this very information, thus demonstrating that they did not even bother to look at it!
    The scary thing is, these people are allowed to vote. ...

I was not convinced by the lawsuits filed by Philip Berg, Andy Martin, Jerome Corsi, and others seeking disclosure of Obama's birth certificate. I was not convinced by the books and articles that now abound contesting Obama's origins. I was convinced by the behavior of Barack Obama and his lawyers, asking the governor of Hawaii to seal Obama's birth certificate so it could not be seen, by anyone, and by the behavior of Barack Obama and his lawyers, sealing his records at Columbia University and Harvard Law. ABC's World News, in a piece by Ron Claiborne, aired a much longer audio soundbite from Obama: "One of the, I think, tragedies of the civil rights movement was because the civil rights movement became so court-focused, I think that there was a tendency to lose track of the political and community organizing and activities on the ground that are able to put together the actual coalitions of power through which you bring about redistributive change."

Philip J. Berg, Esq, Former Deputy Attorney General of Pennsylvania, alleges that Barack Obama is not eligible for the Office of the President of the United States because Obama was born in Kenya and is an Indonesian citizen. Judge Surrick signed a ruling stating that Berg did not have standing to bring the case, and Berg is appealing to the Supreme Court.
     Today represents the turning point in this story; not only the smoking gun, but the powder burns as well. We have learned that US District Court Judge Honorable R. Barry Surrick originally ruled AGAINST Obama, deciding that he was not a "natural born" or "naturalized" citizen, and was therefor ineligible to serve as President of the United States. He also ordered that the Democratic National Committee cease all campaign activity on behalf Obama, and that his name be removed from all election ballots
     That decision was then spiked, pulled off the court's computers, and replaced with the current decision favoring Obama.
     We have also learned that the current decision was not written by Judge Surrick at all, but was faxed to him from elsewhere. The prime suspects are Obama's attorneys or Judge Surrick's former clerk (2004-2005), Christopher Seaman, of the law firm Sidley-Austin, the former employer of Barack & Michelle Obama, and law firm alleged to be representing Bill Ayers.
     For those of you who have not seen our previous coverage, and hold the opinion that Obama produced a valid American birth certificate, should look at our proof that the Obama-produced certificate is fake. We originally ran this on Monday.
     There is no longer any room for doubt. The facts are irrefutable. Obama's candidacy is illegal. He must be removed from the ticket and prosecuted to the fullest extent of the law. This has nothing to do with ideology. Those of you who plan to vote Democratic can still do so; you'll simply have Hillary or Joe Biden as your Presidential Candidate. As the polls tighten, you would actually be better off, as all the disaffected Hillary supporters planning to vote for McCain would return to the fold.

A fax copy of the decision from Judge Surrick, faxed to Mr. Berg from the Judge's Chambers, pages 1-36, beginning at 18:09 October 24, 2008, and that is clearly notated by the receiving fax, starting at page 01/36. Page 36/36 is marked 18:16 October 24, 2008. What is interesting is not at the TOP of the fax pages; it is at the bottom.
     The decision from the office of Judge Surrick have a "fax date & time" stamp at the BOTTOM of its pages that show the decision originated elsewhere and was faxed to Surrick. The Constitution clearly sets out the scope of the federal government's powers in positive language as well as negative. And he said that, sure, if the industry wants to build coal fired power plants, then they can go ahead and try, he says, but they can do it only in a way that will bankrupt the coal industry, and he's comfortable letting that happen. At least one West Virginia coal industry leader said he was shocked by comments Democratic presidential candidate Barack Obama made earlier this year concerning his plan to aggressively charge polluters for carbon and greenhouse gas emissions. ...

There are so many smoking guns in the Certifi-Gate story, it's a wonder they haven't set off the Major Media's smoke detectors yet.
     While we were all still eagerly awaiting API's release of the Michelle Obama Tapes, out of the blue came the Kenyan Ambassador Tape. Below, listen to a recording of an interview with His Excellency Peter N.R.O Ogego, Ambassador from the Republic of Kenya, in which he admits that Barack Obama was born in Kenya.
     Having failed to shut down African Press International, the Obaminions have gone after Leo Donofrio. Due to continuous denial of service attacks directed at blogtext.org in order to hit Leo Donofrio, he's had to move his blog. The new address is http://thenaturalborncitizen.blogspot.com
     The lame attacks against The March Report have taken a different form. They've gone after us on "Blogged," a website that posts reader evaluations of sites such as this. The latest, from another one who hasn't bothered to read this site, decries our alleged "inability to tell left from right" because we post articles from both sides of the political spectrum. Excuse me, but isn't that called ... BALANCE? Our Mission Statement clearly states "To the best of our ability, we will not skew our coverage to the left, right or center. We say 'to the best of our ability' because, now matter how hard someone tries, absolute objectivity is impossible."
     Contrary to the statements of our opponents, this is not a right-wing site. It's a news site, with less than 10 per cent of our coverage devoted to politics. We even have syndication deals with several major mainstream media outlets, which anyone who actually looked at the site would know.
     When we do opine, we decide each issue on its merits, and hold views that would infuriate conservatives, liberals, and libertarians (in some cases, simultaneously). The Certifi-gate issue is very simple: Obama does not legally qualify to serve as President of The United States. per Article II of the Constitution. It has nothing to do with his party, his views, his ethnicity, or anything else. He CANNOT legally serve. End of story.
     Conversely, "kevin p." posted a really nice review, but misstates one of our positions therein. He says, "however in one of the early installments of certifi-gate, you stated that you didn't believe that [Obama] was a natural born citizen, but you thought it better if the courts just let it go instead of up-holding our constitution and dealing with the aftermath as it may come." That isn't what we said; what we did say was that we doubted that the Supreme Court would find the courage to correctly decide this issue. We also suggested that the Constitution should be amended to allow naturalized citizens to serve as POTUS, but that would take years, and would not be retroactive.
     If Obama chose to run AFTER passage and ratification of such an amendment, and managed to secure the nomination of his party, so be it. If he managed to win, that would be the will of the American People. But NOW, there is no such amendment in place, he cannot legally serve, and therefore he must be removed, by the Supreme Court, by the Electoral College, by Impeachment, or whatever other legal means available.
     However, I'm also a realist. I genuinely don't believe this will happen. Most people in office care about one thing and one thing only: keeping their jobs. No one wants to rock the boat. We may well be stuck with an illegal President. I truly hope I'm wrong, but I don't believe I am. Please, someone, prove me wrong.

 AND TEXT. Mike Clark and his "Mike In The Morning" cohorts placed a call to the Kenyan Embassy, as a part of typical morning show hijinks. Unexpectedly, they ended up with a key revelation in the Certifi-Gate story.
     The receptionist at the Embassy of the Republic of Kenya in Washington, DC connected them with His Excellency Peter N.R.O Ogego, the Ambassador himself. In the course of about 10 minutes of conversation, they discussed mostly tourism issues, to put the Ambassador at ease. Near the end of the conversation, they asked him about plans to honor Barack Obama's birthplace in Kenya, and the Ambassador calmly revealed that Obama was in fact born in Kenya.

United States Supreme Court docket no. 08A407, Donofrio v. Wells, is now "Distributed for Conference of Dec. 5th, 2008" to the full Court meeting in private on that date. The case was the subject of previous sabotage by SCOTUS stay clerk, Danny Bickell (as well as judicial misconduct by NJ Appellate Division Judge Jack M. Sabatino). Bickell, after receiving the emergency stay application which requested extraordinary relief to stay the national election, took it upon himself to deny the application on the very time sensitive date it was filed, Nov. 3, a day before the election day popular vote ...

Obama's natural-born status is in question because of his dual citizenship (more precisely multiple citizenships: British, Kenyan, Indonesian, US), NOT because of his birth place. That's why the Donofrio case has the most merit, in our view. Maybe the SCOTUS agrees; maybe not. We'll soon see. ...

Congratulations are due you if you've made it this far. Our website has been swamped since posting the audio recording of His Excellency Peter N.R.O Ogego, The Kenyan Ambassador, admitting that Barack Obama was born in Kenya.      Today, we post, both in video and text form, a detailed forensic analysis of the Certificate of Live Birth posted on the Obama "Fight the Smears" site, and on "Daily Kos." This reviews in greater detail the proof that this document is a poorly-done forgery, and that, even if it were genuine, it is legally insufficient to serve as proof of Natural-Born Citizenship, in that Hawaii grants such certificates to non-Natural-Borns. On our Certifi-Gate Page, we have even posted the identity of the alleged forger. What's really scary is that this gut was supposedly trained by the Department of Homeland Security!
     March Report reader and March Report Daily Update subscriber, "Lynda," has sent us a copy of her daughter's birth certificate. She says that the form is virtually identical to the form used in Hawaii at the time.
     White House Deputy Press Secretary Tony Fratto, when directly asked about Certifi-Gate, neatly dodged the question, as the transcript of the session presented below shows.
     The March Report has been extensively quoted throughout the world on the Certifi-Gate story, but even we were surprised when we were verbosely quoted on the Christian Living Blog, which sites several biblical references to condemn Obama. Having been a practicing Buddhist for 37 years, I'm not qualified to comment on any of that, but present the story below for your review. I hasten to add that it contains certain language and racial characterizations that I cannot agree with, and in fact find offensive, and stress that the appearance of this link here should not be regarded as an endorsement of the views presented therein. We present it for your information only, in that anyone is entitled to express their opinion. The following report is the culmination of over four months of intensive, empirical research whose sole purpose has been to determine if the images and photographs posted on the Internet are true reproductions of a genuine document purported to be Obama's original birth certificate. The idea for the research actually began from the time when the first image was posted on June 12 to the Daily Kos blog. I don't recall on which website I actually saw the story, but the news had gone viral basically from the moment that it hit the Internet ...

Barack Hussein Obama has been vetted by no one. If a decision, handed down by a California court in a case challenging the eligibility of McCain to appear on the California ballot is to be believed, the only course of action left to the American people, if this matter is not settled before December 15, 2008 when the electoral college meets, or is not settled by the electoral college when it does meet, is to seek court action at that time, roughly one month prior to the date Obama should be sworn in ...

My daughter was born in Michigan, but her certificate is almost identical to the Hawaiin certificate you showed in your reports on Certifi-Gate. As Obama's fits in the middle of my daughters and the other, one can see there is something terribly wrong with his. It is without a doubt, a newer version that has been changed." ...

We, the nobody bloggers, worked our fingers to the bone, many of us sacrificing whole chunks of our lives, because the paid professional media class - en masse - refused to be independent. They committed voluntary malpractice, regurgitating faxed or emailed campaign talking points as "news" instead of checking essential facts, much less pursuing an actual story ...

The Michelle Obama tape seems to have given hope to many Americans who disagree with Mr Obama. This only makes us in API to be even more determined to release it now that we seem to be overcoming the obstacles that were put before us by our enemies who made sure we were shut down three times., leaving us with no Internet site to release information in connection with the tape
     Those who were against the release went a long way to block us, but now it is our turn to be the masters. At 7:48 PM on Nov 23, Dr. Douglas Schell, Chair of Democratic Disaster, an organization active in trying to get electors to vote down Obama, left a voice mail message for me, saying that he was urgently trying to reach Leo Donofrio, and asking for contact information. Since all of my information from Leo has come through third parties, I could not comply, despite vigorous attempts to locate such information. I say "vigorous attempts" because there was a tone of concern in Dr. Schell's voice.
     I don't know if there is a direct relation or not, but it has been revealed that there are allegations of a credible death threat against Leo Donofrio, by supposed Islamist terrorists, and that he is now under FBI protection. The source of this information is supposedly a North Carolina Congresswoman, who did not want her name used.
     The March Report placed calls to the Congresswoman in the hopes of obtaining an interview, but her office was closed for to the Thanksgiving holiday. We left a phone message, and made clear that we would withhold her identity, and disguise her voice on the recording of our interview. Keep your fingers crossed.
     Given that the Islamists have denounced Obama, we consider it unlikely that the threats come from real Islamists. More likely, those making the threats are engaged in "dis-information," to try to make Leo and his supporters look foolish. There is a regrettable anti-Muslim subtext in many of the posts on this subject by those who do not recognize the difference between genuine Muslims and those who call themselves "Islamists," who have hijacked the West's perception of Islam by means of terrorist acts
     Blogger.com has also flagged Leo's new site, for supposed "Terms of Service" violations, although it does continue to allow access after you view a warning page. Blogger.com is owned by Google, and Sergey Brin, President of Technology and a Director of Google, is an active Obama supporter. Have a look, read Leo's Blog, and Blogger's Terms of Service; see if you find any violations there (other than failing to genuflect before "The [Ineligible] One." Blogger says that "Blogger is a free service for communication, self-expression and freedom of speech." Unless, of course, they don't like what you say.
     For the record, Donofrio's position is that NEITHER Obama or McCain are eligible to serve as POTUS. For those of you who will write in to call us and/or him a "right-wing nut job," Donorfrio is the antithesis of that. He as an apolitical but politically correct liberal, so far as I can tell. We received a lot of panicky e-mails from readers who were concerned if we had "been attacked" by the oponents of Certifi-Gate, either because we had not posted a new issue in 4 days, or because they had some difficulty listening to our interview with Dr. Douglas Schell.
     Relax, please. We're fine. Although we do get threats by mail and phone, they're mostly bogus. Frankly, we're just not important enough to bother hitting, as we are merely reporting on the issue, rather than actively litigating it. What happened is this: we took a break from the brutal hours we put in on this, and our other business endeavors, to recharge our batteries over the Thanksgiving holiday, expecting that this would be a period of low readership, as our readers did likewise. To our surprise, hits to our website remained steady over the holidays.
     Secondly, the problems that those of you having difficulty playing the Schell interview are having are technical in nature, not sabotage; they are the product of insufficient memory or disk space on your computer, an older browser that does not properly execute the necessary coding, or attempting to access it during peak-demand periods on our server.      December 1, 2008 is here. It is the date that Obama, et al. are are required to file their response to the Writ of Certiorari obtained by Phil Berg in the United States Supreme Court. Don't get your hopes up too high; I fully expect the SCOTUS to wimp out.
     On Wednesday night, I had a very disturbing conversation with a well-educated woman, who told me that she didn't care if an Obama Presidency was legal or not, because she wanted him to be President. I spent easily half an hour on the phone with this woman, an employee of an ivy-league institution, and working towards an advanced degree, explaining the constitutional issues and other ramifications to her, to no avail. I found the conversation extremely depressing, not because she would not listen to the data, but because her attitude is representative of those on the left who want Obama, no matter what the cost. Obama has cleverly crafted himself as a mirror, in whom those who support him see their vision of "change" reflected back to them, whatever that might be, despite any contradictions or affirmative indications to the contrary.
     In the middle of the last century, as a child in a 6th Grade History class, I asked my teacher what would happen when, as those in Government who had experienced the Great Depression died off or retired, and were replaced by those who had never experienced it, who would, in my young opinion, would most likely dismantle the laws put in place to prevent another such occurrence. My teacher assured me that no such thing could ever happen. Oh, really? The teacher was not an idiot; she was simply employing the same kind of thinking that the woman I referred to above was using.
     Those who do not know history are condemned to repeat it. If you are someone who thinks the concerns about Certifi-Gate are overblown, I strongly suggest that you read the history of Germany, starting from 1928, when they faced many of the issues we face now; not only about economics, but about leadership and the legitimacy of government, and especially about the formation of paramilitary groups in the service of those who want "change." The parallells are frightening. The range of human experience is actually quite limited. We do the same things over and over again; only the names, faces and, sometimes, the places change.
     The more things change, the more they remain the same. Here we go yet again.

Judge Bert Ayabe upheld arguments from Republican Gov. Linda Lingle's office, which, inexplicably, has fought tooth and nail to protect the birth certificate from public scrutiny even though it remains the key to establishing whether the man elected to be the next president is actually eligible under the Constitution. ...

     Barack Obama and the DNC have not complied with a Dec. 1 deadline to respond to Pennsylvania attorney Philip J. Berg's petition for writ of certiorari in the SCOTUS (Supreme Court of The United States) demanding Obama produce a legitimate birth certificate to document his eligibility for office.
     A group called Faith2Action, in association with video producer Illuminati Pictures, have produced a 60 second TV ad about the Certifi-Gate situation, and are attempting to raise enough money to air it on the various cable news channels, in the hope of creating enough demand for the information that it will force the news nets to cover the story.
     Edwin Vieira, a constitutional lawyer who has practiced for 30 years and holds four degrees from Harvard, has written an article on the very messy ramifications of a usurper occupying the office of the President.
     "We The People Foundation" ran a full page ad in Monday's Chicago Tribune as an Open Letter to Barack Obama, laying out the Certifi-Gate case and demanding that Obama produce proof of his compliance with Article II of The Constitution.

President-elect Barack Obama and the Democratic National Convention have let a Dec. 1 deadline slip by without responding to Pennsylvania attorney Philip J. Berg's petition for writ of certiorari demanding Obama produce a legitimate birth certificate to document his eligibility for office.

     I guess the Democrat party forgot to check out this guy's background. After all, he grew up in America's most corrupt Democrat party machine in the South Side of Chicago ...

Something wicked this way comes, or at the very least weird. Last night (December 2, 2008), at 23:29 GMT, in the "Grapevine" Segment of Fox News Channel's "Special Report," Substitute host Brett Baer finally reported, however briefly, on Certifi-Gate. He made mention of the ruling to come from SCOTUS on Friday regarding Obama's legal eligibility to serve as POTUS, as well as Hillary Clinton's legal eligibility to serve as Secretary of State. Here is the transcript of that report:

Questions are being raised about Hillary Clinton's eligibility to serve as Secretary of State. That is because of something known as the Emoluments Clause in the U.S. Constitution. Emoluments are salaries. Article 1, Section 6, says:
     "No senator or representative shall, during the time for which he was elected, be appointed to any civil office under the authority of the United States, which shall have been created, or the emoluments whereof shall have been increased during such time."
     Easy for you to say.
     Cabinet salaries have increased by $4,700 a year during Clinton's term. And the rule applies, even if she did not vote on those raises. In the past, presidents have gotten around the provision by requesting that appointees' salaries be lowered to the pre-raise levels, but there's no word still how the Obama administration will deal with the issue.
     Meanwhile, the blogosphere is still abuzz over Mr. Obama's eligibility to serve as president. The Supreme Court will decide Friday if it will hear a case challenging whether the president-elect is a natural-born citizen. One similar case has already been thrown out.

     Yesterday, African Press International had a story announcing that it would file suit against Fox if it did not honor the terms of their agreement to air the Michelle Obama Tapes. A few minutes after the above segment aired on Fox News Channel, the story on API was abruptly pulled; I say abruptly, because the page was deleted before the link to it was deleted, the opposite of normal procedure, which yielded a 404-Not-Found error message when I attempted to make a pdf of the page (which until that moment, I had up on my screen). Coincidence, or a signal. I don't know, as I have not been able to reach Chief Editor Korir by phone, and I have not yet received a reply to my e-mail inquiry.
     On November 14, I e-mailed this advice to Mr. Korir,

"You have been having difficulty concluding a deal to broadcast the Michelle Obama Tapes. This is because all of the American News outlets, including Fox News, are afraid of losing their access to insiders in Obama's camp. Even if a news organization buys them, it will be for the purpose of burying them, not broadcasting them.
     "I have spoken with a major anchor at Fox, who is privately following the story; he made clear that he did not expect anything to appear about it on the air, and he did not sound happy about it. I know why. Murdoch has been cozying up to Obama since last summer, in order to protect his media properties; he was burned badly by Ted Kennedy many years ago in a political vendetta, and learned his lesson. Murdoch's network will not help you."

I wish Mr. Korir had been able to heed my advice, but perhaps by then, the die had already been cast. If you will recall, he had announced back then that a deal had been made with Fox to broadcast the tapes on 'On the Record with Greta Van Susteren' and 'Hannity & Colmes.' Van Susteren denied the story, but Hannity remained silent.
     Below, we link to an archival copy of an article written by the late William F. Buckley, Jr. in the National Review, which describes the Kennedy-Murdoch rivalry as it was in 1988. Shortly after this was written, Murdock was forced to divest himself of the New York Post, which he did not re-acquire until 1993, after it had been owned successively by Steven Hoffenberg and Abe Hirschfeld. Murdoch was only permitted to re-acquire the paper to prevent it from going out of business.
     In the Books section, we post an article by Michael Wolff, the author of "The Man Who Owns the News: Inside the Secret World of Rupert Murdoch," a biography of Rupert Murdoch which posits that Murdock has become more and more liberal personally, but that his positioning of his media assets as Conservative or Liberal is market-driven, not ideological.
     One must remember that Fox News, and in fact, all media properties are businesses first (so is The March Report, albiet on a much smaller scale), and must survive in order to accomplish anything. The fact that the story was mentioned at all on Fox is encouraging, so don't despair. Just hold your breath unti Friday.
     Yesterday morning we received a very nice note from Joan Swirsky, author of over a dozen books and a New York Times columnist, complimenting us on the quality of our work. Praise from such a source is indeed gratifying. Ms. Swirsky's article for today "Obama The Trojan Horse," appears below; it is well worth reading, particularly in light of our column yesterday wherein we drew parallels between what's going on in the US now, and Germany in 1928.

Joan Swirsky speculated that President Bush might have received highly credible evidence from our enemies that they had a number of devastating (probably nuclear suitcase) weapons - set up and ready to be activated in as many as six-to-10 of our major cities - unless he had his functionaries direct all media outlets to steer clear of the birth certificate issue or face Draconian consequences. ...

On November 19, 2008, the official United States Supreme Court Docket for case number 08A407 - Leo C. Donofrio v. Nina Mitchell Wells, Secretary of State of the State of New Jersey - was updated to show that the "emergency stay application" to halt the national election and Electoral College meeting of 2008 ... was "Distributed for Conference of December 5, 2008." ...

Wrotnowski v. Bysiewicz "has been officially tendered to the Supreme Court ..." All things get weirder when it concerns Barack Obama. Wrotnowski, allegedly, was told by the Court that his emergency stay renewal was referred to an ANTHRAX CONTAINMENT FACILITY!
     Dr. Orly Taitz wrote to the Supreme Court, saying "Mr. Wrotnowski is a law abiding citizen, a business owner, was never in trouble with the law. Why was his petition delayed by a week via sending it to the Anthrax lab. No response was received, no name of the clerk was given. These clerks are sabotaging anti Obama cases to put a foreigner in the White House, this is bordering on aiding and abetting treason" ...

Was Obama vetted when he took the Senate seat? What information does CIA have on his background on where he was born, the citizenship issue and his adoption? Will CIA say anything about this if there is a demand from the American people or will they keep silent for the respect of their former popular boss, Robert Gates? ...

We The People said they also considered a similar ad in USA Today, but said the cost was prohibitive. They considered both the Chicago Sun-Times and the Tribune, but said his group settled on the Tribune because of the size of its pages and its larger circulation. He would not specify how much his group spent on two days of full-page ads except to say they cost tens of thousands of dollars and were paid for by donations from supporters.
    A Tribune advertising spokesman said the newspaper has standards for what ads it will accept and that the ad met those standards ...

A lawyer playing a major part in a California lawsuit urging officials to prevent the state's 55 Electoral College votes from being recorded for Barack Obama until questions about his citizenship are resolved has written to county clerks around the state, seeking an investigation into a process that has allowed a dead woman to be listed as an official elector ...

If the Electoral College [elects] him as President of The United States of America on December 15, 2008 and Congress ratifies that choice, and it is later proven that he is not a US citizen, then not one single word he utters will be valid as representing this country. The Courts, our police, our military will have no duty to obey anything he signs. It is also possible that certain people, who were part of and promoted the con, may be charged with Treason. ...

Today is C-Day: the day that all nine Justices of The U.S. Supreme court meet to consider Leo Donofrio's lawsuit that claims Barack Obama is not a "Natural Born Citizen," as defined by Article II of the Constitution. In that Justice Clarence Thomas agreed to review Donofrio's petition after Justice David H. Souter had denied it, that's at least one "nay" vote we be be pretty sure of. It will take at least four "yea" votes out of the remaining eight for this case to be heard in open court.
     Dr. Orly Taitz has filed a "Petition for Extraordinary Writ for Mandamus for Stay" requesting that the Court issue an emergency stay of the voting of the electors.
     Christopher Earl Strunk has filed an Emergency appeal with the Supreme Court Justice Ruth Bader Ginsberg in reference to the denial of his Writ of Mandamus.
     Arap Korir of African Press International claims that the CIA has demanded hat he hand over his original recording of Michelle Obama; he has refused. Much like the "blue dress" of Clinton-Impeachment fame a decade ago, the existence of the "Michelle Obama Tape" has been called into doubt, as there has been delay after delay in producing it. Phil Berg and an unnamed Canadian Lawyer are representing Mr. Korir.

The Supreme Court plans to meet Friday to decide whether to hear a case that could determine whether President-elect Barack Obama ever becomes the nation's president. Justice Clarence Thomas picked up the petition to hear New Jersey attorney Leo Donofrio's lawsuit after it was denied by Justice David H. Souter. Justice Thomas referred it to the full court, which decided to distribute the case for the judges' conference ...

We understand everyone is eager to learn what occurred on December 1, 2008, at the U.S. Supreme Court. There is a rumor claiming Mr. Obama was Court Ordered by Justice Souter to turn over his birth certificate by December 1, 2008. This is NOT true ...

Sarah Herlihy, a lawyer in the Chicago law firm, Kirkland & Ellis, wrote an article that was published in the Chicago-Kent Law Review, that said "The natural born citizen requirement in Article II of the United States Constitution has been called the "stupidest provision" in the Constitution, "undecidedly un-American," "blatantly discriminatory," and the "Constitution's worst provision." Since Arnold Schwarzenegger's victory in the California gubernatorial recall election of 2003, commentators and policymakers have once again started to discuss whether Article II of the United States Constitution should be amended to render naturalized citizens eligible for the presidency." Under the "Memberships & Affiliations" heading of his web page, Bruce I. Ettelson, a partner in Kirkland & Ellis, cites himself as having served as a "Member of finance committees of U.S. Senators Barack Obama and Richard Durbin."
     The page also says, "... the Chicago Sun-Times named Mr. Ettelson as one of five elite lawyers who are the 'go-to guys for private equity'," stating that he is "widely recognized as the top fund formation lawyer in the city, and one of the best in the country." ...

Many have not understood the pressure API has had to go through in over 45 days since the story broke out. The warnings by CIA operatives has not made things easier and so has their refusal to accept the copy of the tape and the Imam's document-copy, only demanding to have the originals putting API into a re-thinking position in the whole thing. The CIA operatives have been given the final offer to listen to the original tape, but with the presence of API's Chief editor and API's Canadian Lawyer, but that has not been welcomed, instead the demand to have the original and to listen to it alone has been given the highest priority, a choice that API has refused. ...

We're very late posting today's issue, due to developments which will become clear as you read this.
     The Supreme Court will not issue a decision as to whether or not it will grant a hearing of the case of Donofrio vs. Wells, questioning the eligibility of Barack Obama to become President of the United States due to concerns regarding the allegation that he is not a "Natural Born Citizen," until Dec. 8, according to a court spokeswoman. The Donofrio case was not one of the two cases granted a hearing on December 5.
     This might mean that they are taking the time to write up the legal reasoning behind a dismissal of the case, or that they are evaluating taking all the pending cases as a group, or possibly that they are quivering in their robes as to what the public reaction might be if they disqualify Obama.
     I do not mean to imply that the Court will play politics with this, but that they would be fools not to be aware of the possibility of civil unrest. I do mean to say that everyone, including the nine Justices, view everything through the filter of their own beliefs. The court is made up of four conservatives, four liberals, and a swing vote. Souter has already telegraphed his vote with his initial rejection of Donofrio's petition. Thomas also telegraphed his by breaking with usual practice and accepting Donofrio's petition after Souter's rejection, unless he did so to prevent it from being presented to the others in turn until someone accepted it.
     I'm hoping that the court grants a hearing to the case, but am pessimistic as to the odds of their doing so. Then again, Leo may roll a lucky seven.
     CNN ran a story on Donofrio vs. Wells on December 5, 2008, wherein they managed to get just about everything wrong; we've got it, below, as well as an AP story that gets it (mostly) right.
     On Friday, in the A-block of MSNBC's "Morning Joe" at about 11:03 GMT, Mika Brzezinski, Mike Barnicle, and Willie Geist discussed the case amid gales of derisive laughter. Joe Scarborough was late due to illness, and not present for this segment. Complete ignorance of the relevant facts did not stop them from opining. Brzezinski laughed as she read the story, and then shrieked "Oh, come on." Barnicle made comments such as, "Who filed this suit," "Stop it, just stop it," and "people complaining about the courts being backlogged."
     This is not the first time Mike Barnicle has spoken without a full grasp of the facts. In fact, he was fired by the Boston Globe over an alleged fabrication in a column. After Barnicle resigned, one of the subjects of the story stepped forward, saying she had not spoken with Barnicle and that the column contained factual errors.
     Mika Brzezinski is the daughter of Zbigniew Brzezinski, an Obama Foreign Policy advisor, who will probably serve Obama as well as he served Jimmy Carter. Remember all the great Foreign Policy triumphs of the Carter years? (When I originally typed this, I made a "Freudian typo," typing "Crater years." I thought about leaving it in.) Brzezinski is a Polish name, the feminine form of which is Brzezinska. Mika, learn to spell and pronounce your own name before discussing more complicated issues.
     It was Joe Scarborough himself who declared 2008 "the year journalism died," citing MBNBC's own "coverage" of Obama (I believe he used the phrase "in the tank for") as proof. Too bad he was not there to witness yet another example of it.
     If the above commentary seems uncharacteristically vitriolic, it is because I know of the sweat and tears that have been expended on this issue by very good, highly competent people, not the least of whom are Phil Berg and Lisa Liberi.
     I'm furious to find that we all may have been "played" by someone we trusted, who may not have been entirely candid with us: Arap Korir of African Press International; details below. Those of us involved in investigating this case must be scrupulously honest and above-board in all of our dealings, and it pains me to report that API may not have been.

Disturbing Allegations about Arap Korir and African Press International

The March Report received the e-mails below from a third party, and immediately took steps to verify that they were llegitimate. We e-mailed and phoned Phil Berg's Office and Arap Korir's Offices in Norway and The U.K. We also e-mailed Linda Starr at the e-mail address listed on her website, but that e-mail was bounced as "User unknown in relay recipient table."
     As we were about to post the Saturday, December 6, 2008 issue of The March Report without this story, having up to that point been unable to confirm it, Lisa Liberi of Phil Berg's office called, and verifed the information contained therein. I also read a bit of the e-mails to Lisa, who knows Linda, to ask if they sounded like Linda Starr's writiing style. Lisa said that it did sound like Linda.

"Initially, we thought these people were credible. Phil agreed to represent them in order to facilitate the elease of the Michelle tapes to legitimate news forums. The agreement had certain commitments attached to them that Korir and API had to fulfill in order to cement the representation. Korir kept giving us to believe he had taken the necessary steps to fulfill the commitments. After he failed to do anything required to cement the agreement of representation, we painfully came to the realization we had been duped. While he seems sincere, he is in fact an excellent con man and spin doctor. We learned in a public announcement that not only had he not done anything he was required to do, but he had allegedly retained other counsel without even telling Phil anything.
     "Believe me, I wanted to believe him as much, if not more, than just about anyone. It is my willingness to believe people at risk that has provided so many opportunities to link whistleblowers with good journalists who will get the stories out in the media. Does it at times set me up to try to help people who are not honest? Yes. But I wouldn't be so good at networking people together if I weren't willing to listen when others won't. It is my willingness to listen that has opened up so many scandals and crimes to the light of day. I hope I never stop listening. When and if I do, I will lose my effectiveness in the cause of truth and honesty. So yes, i risk deception once in awhile. And that is also how and why they were able to deceve Phil and Lisa.
     "Alas, we were eventually forced to admit it was a hoax. You know, because of our previous expereriences with opposing powerful political personalities, we could relate to some of the eccentrities of Korir. We chalked it up to his fear of retaliation. I've networked a lot of whistleblowers with people like Greg Palast over the years, so I'm used to overly cautious and even paranoid people. I'm used to empathiziang with eccentricities of fearful people. It's a normal fact in dealing with whistleblowers. We were very sadly mistaken. Maybe because of the doubting Thomas' I've encountered over the years myself when I've exposed something, I undrstand how these people think and feel. Because of my experiences and high degree of integrity, I tend to believe other people are just as honest as I am. I even expect strange behaviors, but this is flat out crazy. Phil has had to issue Cease and Desist demands that they stop invoking Phil's name or claiming he represents them. They are now lying that the tapes were sent to our webmaster. I have known our webmaster for 7 1/2 years. There is not so much as a tracking number linking delivery of any tapes to our webmaster. API cannot produce one that will show they sent anything to Phil or the webmaster. It's just not true. Sorry. I won't have lies spread to get them off the hook for all the lies they told everyone who kept hanging on their every word.
     "I have since come to the conclusion that this was a deliberate setup to try to damage Phil's credibility by Obama trolls."

"Yesterday, a heated email exchange occured between API's Sammy Korir and Lisa, Phil Berg's Assistant. Lisa continues to insist that any agreement they had to represent API was violated by Sammy Korir when he failed to produce the documentation and tapes in order for Phil to negotiate a release. In fact, without telling Phil anything, API allegedly hired two other lawyers, a Canadian and an American, and allegedly proceeded to negotiate with Fox, without Phil's input or advice.
     "API was required by contractual agreement to produce the tapes and documentation to Phil so that he could negotiate a deal for them and facilitate their release of the tapes. In order for Phil to represent them, he had to have the tapes and documentation so he could protect the integrity of the tapes. Fox claims no such negotiation was ever entered or any contact made with API. API never sent anything to Phil or the webmaster, even though they repeatedly claimed to have sent the items. No tracking number was ever provided and DHL, which API claimed was the shipping company, stated nothing was brought to them for shipment or requested anything be picked up.
     "Now, Sammy Korir is angry and wants Phil and/or Lisa to stop telling people there are no tapes and this is a hoax. Sammy Korir continues to falsely state things that are simply not true.. He is claiming Phil begged to represent them and other false statements. Phil offered his assistence to API to facilitate the release of the tapes. API did not fulfill their end of the deal to finalize the representation. I see this latest exchange between Sammy Korir and Phil Berg's assistant, Lisa, as an attempt to commit the crime of extortion by threatening Lisa with suit if Phil or Lisa makes any public statement denying API's claims of representation. I don't know what API is gaining from this fraud, but we do not believe they have any such tapes.
     "I have urged Lisa and/or Phil to make a public statement denying representation of API. I do think that will be forthcoming in the next day or so."

No announcement was made on Friday from the Supreme Court about whether it will hear what I call the Obama-isn't-a-natural-born-citizen-so-he-can't-be-president lawsuit, officially known as Donofrio v. Wells ...

 AND TEXT. This story ran on CNN on December 5, 2008. It is a report on the case of Leo C. Donofrio v. New Jersey Secretary of State Nina Mitchell Wells, which seeks a ruling that Obama is ineligible to serve as President of the United States due to his failure to meet the "Natural Born Citizen" criteria defined in Article II Section 1 of The Constitution. ...

     As we expected, and said in Saturday's column, The Supreme Court announced today that it refused to hear Donofrio v. Wells, the case in which Leo Donofrio contended (incorrectly, in the opinion of most of us investigating this; listen to the Liberi interview for more details) that, although Obama was born in Hawaii, he was ineligible to serve as President due to his father being a British subject at the time of his birth. Donofrio also contended that John McCain was also ineligible (wrong) as was Socialist Workers candidate Roger Calero (right). What we did not expect was for the announcement to be made without explanation; that could easily have been done on Friday. Why the delay? How many ash trays were thrown?
     Contrary to the proclamations of victory by the Obaminions, this is nothing of the sort. The Supreme Court simply did not rule. Either way. They wussed out. This one case, and this one case only, is dead in the water. The cases with the most chance of success -- Phil Berg's and Alan Keyes' -- are still on track, as are several others. This would have been the wrong one to win it with, anyway, as Donofrio's contentions were incorrect, except in regard to Calero.
     In a story originally posted on August 21, 2008, and updated on November 1, 2008, Factcheck.org claims to have done an independent investigation of the situation, and says, "FactCheck.org staffers have now seen, touched, examined and photographed the original birth certificate," the group writes. FactCheck.org staffers have now seen, touched, examined and photographed the original birth certificate. We conclude that it meets all of the requirements from the State Department for proving U.S. citizenship. Claims that the document lacks a raised seal or a signature are false. We have posted high-resolution photographs of the document as "supporting documents" to this article. Our conclusion: Obama was born in the U.S.A. just as he has always said." In the November 1 update, they say, "The director of Hawaii's Department of Health confirmed Oct. 31 that Obama was born in Honolulu."
     Wrong on all counts. The "Birth Certificate" shown in Factcheck's story is the infamous "Certificate of Live Birth," which, even if genuine, is NOT legally sufficient to prove natural born citizenship, as the COLB is also issue to foreign-born children. A COLB is not a birth certificate. Hawaii's Department of Health never confirmed that Obama was born in Hawaii. What Health Department Director Dr. Chiyome Fukino said was that she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama's original birth certificate. Note that they did not say Hawaiian birth certificate. In order to obtain the COLB, Obama's mother would have had to present some form of documentation, which may well have included Obama's Kenyan Birth Certificate. BOTH hospitals that the Obama family have contended Obama was born in have denied having any record that he was born there.
     Paraphrasing (very badly) the late Johnnie Cochran, "If you can't prove you're a Natural Born Citizen, then you can't be a White House denizen." (I said, "very badly.")
    
     We have not yet heard from Arap Korir of African Press International regarding the information presented in the Liberi interview and in our Saturday Certifi-Gate column (Part 31); he now claims that he has been invited to the Obama inauguration, but "There will be a problem if API accepts the invitation. The news organization will be compromised because of the tape on Obama and the Imam document scheduled for release in the next few days." Since Korir's credibility has been stretched beyond the breaking point, we are not posting the article here, but have kept a pdf for our records. Until such time a Mr. Korir satisfactorily refutes the allegations made here Saturday, we regard his silence as damning in and of itself. Still, I'm leaving the door ajar for him to respond. If he does, we'll run it here.
    
     Mika Brzezinski was in a bit of a snit, today; both on MSNBC's "Morning Joe," and on the new "Joe and Mika" Show on WABC-AM Radio, the Talk radio Giant in New York City. We received an unsubscribe request from "breezyandmikimom" (domain name withheld), claiming she had asked to unsubscribed several times, but this was the first we had ever heard form her. Mika's address? Maybe, maybe not. We have nearly half a million subscribers to the 18 various versions of our newsletter. Whomever it was, we unsubscribed the address, per the request. But, Mika, as to your attitude about Certifi-Gate, "Weiçej w dupie gówien nizli w glowie mózgu."

Needless to say, the questioners will not be persuaded by the court and media, and will continue to press their case. It will be difficult row to hoe. They will be ignored, or at best mocked when they are noticed by the media. If there is any truth to their claims, proof will have to be developed without the powers of subpoena or massive public pressure. ...

Sometimes life intervenes. A power outage in our vicinity shut us down for a few hours, and today's issue is late and truncated as a result, so I'll keep my usual commentary short.
     Much of today's issue is devoted to the Gov. Rod Blagojevich corruption scandal, rather than Certifi-Gate, but it's interesting to note how the media has rushed to emphasize that Obama had no contact with "Blago," despite evidence to the contrary. It's interesting to note how easily they accepted that David Axelrod misspoke -- in paragraphs, or how Rahm Emmanuel, Obama's pick for Chief of Staff, never discussed a bribe with Blagojevich, and never, never, never made a counter-bribe-offer.
     Yea, and Barack Obama is a Natural Born Citizen. NOT! Don't automatically believe what you read anywhere, not even here. It's all just data to be sifted and evaluated before forming your own opinion.
     Paraphrasing a great man who is sorely missed, "Read, but verify."

At least in the short run, Obama's supporters probably will prevail, even though Obama's actions stink with suspicion and the proof given of his citizenship is not proof at all. They will succeed because politicians tend to either be spineless followers or unapologetic dealmakers - at both the state and federal levels (although a writing campaign to constitutional bulldog Congressman Ron Paul (R-Texas) could yield a positive result), and it is unlikely that congressmen, even if there is a congressional objection, will exert due diligence toward finding out the truth of the matter as they are constitutionally bound to do. ...

Leo Donofrio, Plaintiff in Donofrio v. Wells, posted a response on his blog concerning a Washington Times reporter discussing both his and Cort Wrotnowski's Wrotnowski v. Bysiewicz case. ...

There seems to be an effort to discredit the action that Scalia and the SCOTUS took on Friday, Dec. 5, upon the Wrotnowski v. Bysiewicz petition to stay the Electoral College vote. As you may know, this case was referred by Justice Alito and accepted by the full court to committee, which will assess the case this Friday, Dec. 12, in order to decide upon any further action. It could grant a stay, deny the case, call for a brief from the opposition, call for oral arguments, etc. ...
