 Stephen Hawking vs. God

Jim Wilson -- Redding Record Searchlight

Hawking proclaims two mutually excluding propositions in his book, "The Grand Design" according to fellow physicist Dr. Ben Wiker. On the one hand he declares that all existing theories of the origins of the universe are as subjective as they are non-comprehensive. On the other he states that these theories are comprehensive enough - and objective enough - to prove that God neither exists nor is necessary for the existence of everything else. The problem? You cannot have it both ways. If a theory is subjective it is tainted by having been processed through an intellectual lens that sees only what the viewer is prepared in advance to admit. Likewise, if it is not comprehensive it cannot entertain all of the relevant data and so cannot make comprehensive statements. But the declaration that God does not exist is both an objective and a comprehensive statement. It is -- in this case -- a desperate attempt to escape the prime implication of the Big Bang, that there is out there a Big Banger.

John And Abigail Adams: A Marriage That Defied Separation And War

Michiko Kakuta -- New York Times

Although the gender politics of the day did not afford Abigail Adams the opportunities enjoyed by later generations of women, she was John Adams's closest adviser and sounding board before, during and after the Revolutionary War. During his long absences from home, Abigail managed the family farm, oversaw their finances and raised their children. Later, during his diplomatic postings in Paris and London and his tenure as president, she assumed a more public role, so much so that the historian Joseph J. Ellis writes in his new book, "First Family: Abigail and John Adams," that "they were effectively regarded as a political team" -- or as one television dramatization of their lives more crudely put it, "America's first power couple."

When John Waters Met Little Richard

John Waters -- Guardian (UK)

In 1987, the iconic filmmaker John Waters was sent by Playboy magazine to interview his all-time hero: Little Richard. It was a surreal, almost religious experience for John who had been a lifelong fan of the godfather of rock'n'roll. So why did it almost end in a fistfight? All is revealed in this excerpt from Waters' new book, Role Models.

"America By Heart": A Harsh Critique Of Obama By Sarah Palin

Michael Falcone -- ABC News (US)

Video AND TEXT. In the book, "America by Heart: Reflections on Family, Faith, and Flag", Palin accuses Obama of misunderstanding the American people. "The epitome of progressive thinking was Barack Obama's promise, just before the 2008 election, that 'we are five days away from fundamentally transforming the United States of America,'" Palin writes in the book. "I guess you could say that he warned us! But the problem is that Americans don't want a fundamental transformation of their country." Palin portrays herself as a modern-day Jefferson Smith, the character played by Jimmy Stewart in the iconic film, "Mr. Smith Goes to Washington," which she says is her favorite movie.

The Battles For Late Night

Louis Menand -- New Yorker

The Leno-O'Brien debacle might not have happened if Jay Leno had used representation. As Bill Carter tells the story in his hugely entertaining recap, The War for Late Night: When Leno Went Early and Television Went Crazy, Leno fired his manager in 1992, shortly after taking over from Johnny Carson as host of the "Tonight Show." Leno believed that his manager had said things to poison his relationship with Carson. As it was, David Letterman, who, as the host of "Late Night," had been following Carson for eleven years and was considered the heir apparent, felt resentment about being passed over for Leno, whose reputation had been built partly on his many guest appearances on "Late Night." Leno was professional to the core, but he did not want business to ruin friendship. He never used a manager or an agent for his contract renewals again.

Bush: 'Damn Right' I Gave The Go-Ahead On Waterboarding Terror Suspect

Alex Eichler -- Atlantic Monthly

In George W. Bush's new memoir, Decision Points, the former president explains that the CIA approached him about the possibility of waterboarding Khalid Sheikh Mohammed, the al-Qaeda operative often called "the architect of 9/11." In his memoir, Bush writes that his response was "Damn right." This seems to be a straightforward admission that Bush approved the use of waterboarding on a detainee--even though this technique is widely regarded as inhumane, and its use is thought by many to violate the United Nations Convention Against Torture, of which the United States is a signatory. (In media outside the U.S., waterboarding is almost always referred to as torture.)

Review Of Bob Woodward's New Book, "Obama's Wars"

Michiko Kakutani -- New York Times

It's no secret that there have been ferocious arguments within the Obama administration over the war in Afghanistan: both substantive policy debates. Bob Woodward's new book, "Obama's Wars," underscores just how vociferous and highly personal those altercations and message wars often became. Mr. Woodward adds lots of detail and anecdotal color to the story of how the White House's policy on Afghanistan evolved over the administration's first 18 months, and how the decision was made to send 30,000 more troops to Afghanistan (to try to wrest momentum away from a resurgent Taliban) with a drawdown of American forces scheduled to begin in July 2011.

Peter Hitchens Talks About His Faith And His Atheist Sibling Christopher

Charles Lewis -- National Post

Almost everyone knows how his elder brother Christopher Hitchens feels, but less well known are the views of Peter Hitchens, a conservative columnist for the The Mail on Sunday in London, who was inspired to write his latest book, The Rage Against God: How Atheism Led Me to Faith, because of the "dangerous" teachings of men like his brother. It is not a faith book, at least not in the conventional sense of defending doctrine or even making a philosophical case for God. The book is devoid of "faith talk"; the name Jesus does not appear once in the book. "Remember, I'm an ex-Trotskyite, so I'm quite suspicious of the man of total conviction and certainty. What I did not want, coming away from Marxist utopianism, was to find another mirror image of utopianism," he said. "The argument I'm making for religion is largely a negative one: if you get rid of [God] you will be in a tremendous fix."

Bozo The Clown: "The Man Behind The Nose"

Philip Potempa -- Northwest Indiana Times

Did you hear the one about when Bozo ran for president? Or how two assassination attempts were made on his life? How about the time that Bozo flew into the jungles of New Guinea to see if he could bond with dangerous cannibal tribes? Well then, you must know about the time his size 83 AAA shoes saved him from being swallowed whole by a giant, murderous python in Thailand, right? These are just a few of the "prizes" plucked from "The Man Behind the Nose: Assassins, Astronauts, Cannibals, and Other Stupendous Tales," (HarperCollins $25.99) a new 256-page hardcover by Susan Harmon, widow of Larry Harmon, the man credited with creating "the world's most famous clown. The book, released in time for Bozo's 50th anniversary, was co-authored by Thomas Scott McKenzie. The late Larry Harmon reportedly drafted most of the book before his death.

New Book Celebrates George Herriman's Krazy Kat

Doug MacCash -- Times-Picayune

Video AND TEXT. "George Herriman's Krazy Kat, A Celebration of Sundays" is a dynamite introduction to one of the most dysfunctional duos ever found on the funny pages. It's also a book-shelf must-have for anyone devoted to jazz-era expression. But beneath the quirky comedy of the antique cartoon, Herriman's real life story is a disquieting detour through the bad ol' days of American race relations that begins in the Treme neighborhood of New Orleans. Starting exactly 100 years ago (July 26, 1910), Ignatz the cartoon mouse began hurling bricks at the head of his Coconino County neighbor, Krazy Kat. Zip! Pow! It's no wonder that a mouse, given the chance, would torment a cat. Here's the weird thing: For the next 34 years, Krazy Kat fell more deeply in love with Ignatz with each beaning. Try as he might, police officer Pupp could do nothing to dampen either Ignatz's violent obsession or Krazy's misplaced ardor for the mouse that he or she (we're never quite sure of Krazy's sex) called "L'il Anjil."

Fight Over Evolution Still Simmers 85 Years After Scopes Trial

Bob Smietana -- The Tennessean

Rachel Held Evans had a choice while growing up in Dayton, Tenn., site of the 1925 Scopes Monkey Trial. Believe the Bible or believe evolution. "I was taught that if you don't interpret Genesis 1 and 2 literally, then you don't take the Bible seriously," said Evans, 29. "I held on tightly to that for a long time." Evans says creationism -- the belief that God created the Earth around 6,000 years ago in six days -- was commonplace in her town. Unable to reconcile science with her faith, Evans embraced evolution. "I learned you don't have to choose between loving and following Jesus and believing in evolution," she said. She chronicled her personal journey in a new memoir, Evolving in Monkey Town: How a Girl Who Knew All the Answers Learned to Ask the Questions.

Arkansas Game Officials Probe Mystery Of Falling Birds

Cnn

Video The Birds Is Coming -- but without Rod Taylor, Tippi Hedren and Suzanne Pleshette. Arkansas game officials hope testing scheduled to begin Monday will solve the mystery of why up to 5,000 birds fell from the sky just before midnight New Year's Eve. "Something must have caused these birds to flush out of the trees at night, where they're normally just roosting and staying in the treetops ... and then something got them out of the air and caused their death and then they fell to earth," Karen Rowe, an ornithologist for the Arkansas Game and Fish Commission said. ...

YEST Blow-Up At Fire-Works Kings' Family Gathering

Joseph Grucci, 70, a member of the Grucci fireworks family, was charged with first-degree assault after firing at his grandson Christopher Giresi from about 20 feet away, authorities said. Police said the grandson had some friends over and Grucci repeatedly told them to keep the noise down. Grucci told cops his grandson attacked him when he told his grandson and friends to shut up.  Boehner To Promise New Routine In House

Jack Torry -- Columbus Dispatch

Moments after the House's longest-serving member, Rep. John Dingell of Michigan, delivers the oath to Boehner on Wednesday, the new speaker will outline how he plans to run the House. He is expected to offer a sharp departure from the way the House was managed by Pelosi, a Californian, and her Republican predecessors, Newt Gingrich of Georgia and Dennis Hastert of Illinois. "The tone of the week will be upbeat, but not celebratory," said Cory Fritz, a Boehner spokesman. "He'll lay out the first step toward that end, disposing of some of the congressional 'rituals' that in the past have made it easier for Congress to duck tough choices. "Some of these rituals include rushing bills through the House, writing massive bills that are so large they defy proper scrutiny and routinely bringing bills to the floor under closed rules that prohibit reasonable amendments from being voted on." ...

White House Warns Failure To Raise Debt Ceiling Would Mean Economic "Crisis"

FOX News

The debt ceiling debate is one of the first major legislative clashes on tap as lawmakers return to Washington this coming week for the start of the 112th Congress. The $13.9 trillion national debt is creeping closer to its $14.3 trillion ceiling, and a vote to increase that limit is expected in the spring. Though lawmakers will no doubt use the vote to extract promises over future spending cuts, White House Council of Economic Advisers Chairman Austan Goolsbee urged Congress not to "toy with" the issue. "The impact on the economy would be catastrophic. I mean, that would be a worse financial economic crisis than anything we saw in 2008," Goolsbee said. "I don't see why anybody's talking about playing chicken with the debt ceiling." ...

YEST Will Barack Obama's Republican Ambassador To Beijing, Jon Huntsman, Run Against Him In 2012?

McKay Coppins -- Newsweek

Sitting in the echo-y living room of his new Washington home, Huntsman, a tall, lean man with silver hair and impeccable posture, pauses only briefly when faced with the question of presidential aspirations. Asked whether he is prepared to rule out a run in 2012 (since it would require him to campaign against his current boss), he declines to comment. The winking response-about as close to a hat-in-ring announcement as you'll get from a sitting member of the incumbent's administration-could just be a hollow cry for attention. But sources close to Huntsman (who requested anonymity to speak freely without his permission) say that during his December trip to the U.S., he met with several former political advisers in Washington and Salt Lake City to discuss a potential campaign. "I'm not saying he's running," says one supporter who has worked with him in the past. "But we're a fire squad; if he says the word, we can get things going fast." ...

Linda Feldmann -- Christian Science Monitor

From the moment Christine O'Donnell burst onto the political stage, she has drawn comparisons with Sarah Palin. Now, O'Donnell is fighting back against a reported federal investigation into alleged improper use of campaign funds, and is claiming that her home-state "political establishment" is out to get her. But O'Donnell, in fact, is no Palin. The former Alaska governor had held other political posts in the state before winning its highest executive office. O'Donnell has run for office three times -- each time for the US Senate -- and never won. Her victory against Congressman Castle was indeed a stunning upset, but it took place in a low-turnout primary with a right-place, right-time anti-establishment wind at her back. ...

OWN has announced that 22 original programs will debut in 2011, beginning Sunday night. YEST "Stargate Universe" Producers Not Giving Up On Show ... Yet

Wayne Hall -- SciFiPulse

Fans of Stargate Universe, the latest series from the lucrative MGM franchise, were saddened recently when SyFy cancelled the low-rated program. But the story may not end there. Executive Producer Brad Wright recently said that he and MGM are discussing several options. "We haven't given up on finishing the story we started." "It's heartening to see so many people upset about Syfy's cancellation of the show, but it's important to remember that their license fee represented only a portion of our total budget," he said. ...

YEST Estonia Adopts Euro Currency

Jessica Golloher -- Voice Of America

The small Baltic state became the first former Soviet bloc country to adopt the currency just after midnight. The country's Prime Minister Andrus Ansip was the first person in the country to withdraw the Euro, officially switching from the Kroon. He withdrew the money from a cash machine in Tallinn, the country's capital. Estonian officials say switching to the Euro marks the end of its struggles. The country has been in a deep recession since 2009 when economic output dropped by 14 percent. The government says that it hopes to encourage investors by assuaging fears of devaluation in its currency. Estonia is a nation of 1.3 million people with a $19 billion economy. ...

Israeli Discovery Forces Scientists To Re-Examine Evolution Of Modern Man

Matthew Kalman -- Daily Mail (UK)

Scientists could be forced to re-write the history of the evolution of modern man after the discovery of 400,000-year-old human remains. Until now, researchers believed that homo sapiens, the direct descendants of modern man, evolved in Africa about 200,000 years ago and gradually migrated north, through the Middle East, to Europe and Asia. Recently, discoveries of early human remains in China and Spain have cast doubt on the 'Out of Africa' theory, but no-one was certain. The new discovery of pre-historic human remains by Israeli university explorers in a cave near Ben-Gurion airport could force scientists to re-think earlier theories. ...

There's A Mini Ice Age Coming, Says Meteorologist Who Beats "Weather Experts"

Daily Telegraph (UK)

Meteorologist Piers Corbyn seems to get it right about 85 per cent of the time and serious business people (notably in farming) are starting to invest in his forecasts. He looks at the flow of particles from the Sun, and how they interact with the upper atmosphere, especially air currents such as the jet stream, and he looks at how the Moon and other factors influence those streaming particles. He takes a snapshot of what the Sun is doing at any given moment, and then he looks back at the record to see when it last did something similar. Then he checks what the weather was like on Earth at the time, and he makes a prophecy. Piers Corbyn believes that the last three winters could be the harbinger of a mini ice age that could be upon us by 2035, and that it could start to be colder than at any time in the last 200 years. He goes on to speculate that a genuine ice age might then settle in, since an ice age is now cyclically overdue. ...

The Climate Mafia Gather In Cancun

Alan Caruba

It is time for the U.S. government to acknowledge that a climate mafia has existed since the gathering in Kyoto, Japan, to establish the United Nations Framework Convention on Climate Change. The December 11, 1997 treaty was, upon ratification, to go into force on February 16, 2005. Its expressed purpose was to reduce greenhouse gas (GHG) emissions for the purpose of avoiding "global warming," but its real purpose was to create an entirely bogus system of emissions trading to be known as "the carbon market." On July 25, 1997, the U.S. Senate, responsible for the ratification of international treaties, unanimously passed (95-0) a resolution rejecting the Kyoto Treaty on the grounds that it "would result in serious harm to the economy of the United States." As this is written, the U.S. Environmental Protection Agency is striving to secure authorization to regulate GHG emissions despite massive evidence that they pose no threat to the environment and despite the fact that this authority would, as in 1997, cripple and likely destroy an already ailing economy. ...

Global Warming Re-Branded As 'Global Climate Disruption'

James Delingpole -- Telegraph (UK)

Obama's Science Czar John Holdren is worried about global warming. Having noticed that there hasn't actually been any global warming since 1998, he feels it ought to be called "global climate disruption" instead. That way whether it gets warmer or colder, wetter or drier, less climatically eventful or more climatically eventful, the result will be the same: it can all be put down to "global climate disruption." And that will be good, because it will give Holdren the excuse to introduce all the draconian measures he has long believed necessary if "global climate disruption" is to be averted: viz, state-enforced population control; a rewriting of the legal code so that trees are able to sue people; and the wholesale destruction of the US economy ("de-development" as he put it in the 1973 eco-fascist textbook he co-wrote Paul and Anne Ehrlich Human Ecology: Global Problems And Solutions). ...

Obama Blaming Others For His Failures

Michael Goodwin -- New York Post

When word got out that Barack Obama told an interviewer he had learned from his mistakes, the grandees of the political class swarmed to the bait. Like primitive mystics "reading" the entrails of a sacrificial animal, they began dissecting his comments to divine whether the president is signaling a course change after the election. No, he's not going to change. Why mess with perfection? Obama thinks he did everything right and nothing wrong. And he remains stuck on blaming others, including voters, the media, Republicans, Washington, and impossible-to-please liberals. In short, nearly halfway through his term, Obama still doesn't get it. He's clueless about his massive failures, which means, if he's given the chance, we can expect more of them. ...

Eric Alterman -- Daily Beast

In case you hadn't heard, yes Barack Obama did go before a $30,000-per-person Democratic National Committee fundraiser in Greenwich, Connecticut -- the hedge-fund capital of the world -- and (at the home, I kid you not, of a guy named "Rich Richman" ) complain about how silly his base was being. (Laughter.) "If we get an historic health-care bill passed -- oh, well, the public option wasn't there. If you get the financial-reform bill passed -- then, well, I don't know about this particular derivatives rule, I'm not sure that I'm satisfied with that. And gosh, we haven't yet brought about world peace and -- (laughter.) I thought that was going to happen quicker." (Laughter.) White House In Crisis; Will Section 4 Of The 25th Amendment Be Invoked?

Wayne Madsen -- Opinion Maker

Washington has not witnessed so much top level White House intrigue since October 20, 1973, when a Saturday night saw President Nixon fire the Watergate independent counsel, the U.S. attorney general, and the deputy attorney general in the "Saturday Night Massacre." Just ten days earlier, Vice President Spiro Agnew resigned after being charged with accepting bribes while governor of Maryland. In the case of Barack Obama, the senior firings are not happening during a single nght but the recent involuntary sudden departures of the White House chief of staff and national security adviser, along with what is a putative president who is suffering from Nixonian levels of paranoia, depression, and schizophrenia, has some top-level administration officials considering the first-ever invocation of Section 4 of the 25th Amendment -- the involuntary removal of the president from office. The White House meltdown has the Washington political circuit buzzing under the surface. ...

Obama's Errors On Arizona Law Exposed

James R. Edwards, Jr. -- Human Events

The Arizona law reflects the same language as the wording in federal immigration law. The state law doesn't create its own immigration policy. That makes the administration's legal challenge all the more specious. Its arguments parrot those the ACLU, the National Council of La Raza and similar activist groups make whenever a state or locality tries to enact a remedy to immigration-related problems that arise in their community. The Supreme Court and several appellate courts have treaded lightly in cases involving federal pre-emption. The courts have taken a cautionary stance when pre-emption is claimed, because of the slippery slope that easy findings of pre-emption would create. ...

People Are Angry At Obama For The Same Reasons They Were At Bush

Peter Roff -- U.S.News & World Report

Obama is a big spender and an advocate for bigger, more activist government. So was Bush, though not, perhaps, to the same degree. The same people who were mad at the latter were mad at the former, and have enlisted in the Tea Parties. It is only in the mind of a dedicated statist that the desire for smaller, more limited government can seem extreme, radical, or unhealthy. The Tea Party movement is not outrageous or outlandish or even, as someone suggested here on Thomas Jefferson Street just the other day, unthinking. The sense of panic felt on the left has become voluble, making the latest volley of assaults on the Tea Party an effort at explaining that the Tea Party movement is of its very nature irrational, a product of anger, and ultimately not in the country's best interest. ...

Jim Byrd -- Canada Free Press (CA)

Regarding this country's immigration, the only thing wrong with the system in place is the irremediable damage of decades of unwillingness to adequately fund it, the blatant refusal to enforce it, and the preposterous assumption of its harmlessness by the Left. Every president and Congress since Lyndon Johnson shares culpability for the current conglomeration of the 15-20 million illegal immigrants in this country. Hawaii Governor Neil Abercrombie Wants To Reveal Obama Birth Data

Mark Niesse -- Associated Press

Abercrombie, an alleged member of Democratic Socialists of America, claims, "Maybe I'm the only one in the country that could look you right in the eye right now and tell you, 'I was here when that baby was born.'" Abercrombie, 72, has said he remembers seeing Obama as a child with his parents at social events, although he acknowledged that he didn't see his parents with their newborn son at the hospital. ...

The Tingling's Gone.
The Tingling's Gone Away.
Now, Chris Matthews Says "Release Obama's Birth Certificate"

World Net Daily

Video AND TEXT. Chris Matthews, the anchor of MSNBC's "Hardball" program, is now calling for Barack Obama to release his original, long-form, hospital-generated birth certificate to put to rest any doubts about the president's constitutional eligibility to hold office. Matthews was joined by Clarance Page of the Chicago Tribune and David Corn of Mother Jones, who both agreed with the call for Obama to publicly release the document. ...

An Eyewitness To Lt. Col. Terry Lakin's Court Martial Speaks Out

Stan Solomon -- Talk To Solomon Show

Video US Naval Commander Charles Kerchner (Ret.) discusses his eyewitness account of the court martial of Lt. Col. Terry Lakin. Lakin, a decorated officer and physician, had refused deployment to Afghanistan until Barack Obama produced a long form birth certificate to signify a clean chain of command and his ability to issue lawful orders. In this court martial, Lt. Col. Lakin was denied discovery and the ability to call witnesses pertaining to Obama's eligibility because it may "embarrass the President" according to Judge Lind. How exactly it would "embarrass the President" if, in fact, he is legally eligible to serve was never explained. ...

The Lakin Legacy & The Right-Left Hypocrisy

Doug Hagmann -- Canada Free Press (CA)

Bomb the Pentagon, lead a domestic terrorist group that was responsible for 30 bombings, destruction of property and deaths, and suggest that you cannot rule out committing additional bombings, you become a folk hero of the radical left, a close confidant of a sitting president, and hold a position as a professor in higher academia. Alternatively, give your country nearly 18 years of unblemished military service as a high ranking military officer until you request proof that the orders you are given are, in fact, made by someone with the ultimate authority to do so, you are stripped of your military rank, your liberties, your income, your pension, your freedom and are sentenced to Leavenworth. Welcome to the new paradigm of civil disobedience, Chicago style, and where self-proclaimed conservative warriors are AWOL. ...

Lakin Convicted

Brian Fitzpatrick -- World Net Daily

Deprived by trial judge Col. Denise Lind of any opportunity to defend himself by introducing evidence or expert testimony, Lt. Col. Terrence Lakin, the Army doctor questioning Obama's eligibility, has been convicted on all counts. Lakin faces as many as 42 months in prison, forfeiture of pay and retirement benefits and dismissal from the service after being convicted of four felonies. ...

Gen. Thomas McInerney Interviewed On Lt. Col. Terrence Lakin's Court-Martial

Peter Boyles -- KHOW Radio

Audio In an interview with Peter Boyles on 630 AM KHOW radio in Denver, Colo., General Thomas McInerney, speaking of Lakin, said: "He is not a birther, he is a constitutionalist. Now, it shouldn't be the job of a lieutenant colonel and flight surgeon in the U.S. Army to be the constitutionalist. It's the job of the Congress and the executive agency to do that. But we've had 44 presidents of the United States and only one, the current president, has not shown a valid birth certificate." Listen to the entire interview here.

SCOTUS Fears POTUS, But Not Us

Jerry McConnell -- Canada Free Press (CA)

US Army Colonel Denise R. Lind, the presiding judge in a lawsuit that questions Obama's natural born status and requests that the original birth certificate be presented as evidence when Judge Lind said "opening up such evidence could be an "embarrassment" to the president." So it appears that our United States Army, at least in the person of one Army Colonel Denise R. Lind, has placed in jeopardy the 18-year career of a highly decorated medical officer, Lt. Colonel Terry Lakin, over the supposed "embarrassment" of a very possible usurper in our nation's highest elected office who may not even be eligible to be there. Is this the sort of justice we will now be faced with in this once Land of the Free and Home of the Brave? ...

The Natural Born Question: Natural Parents Required

Monte Kuligowski -- Renew America

It may be shocking to many, but the birthplace of Obama is not the primary issue when considering natural born status. The Constitution requires in part that, "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President." A combination of citizenship and something more is required. The something more begins with parents who were United States citizens at the time of the candidate's birth. That's really a matter of common sense. Citizenship status of one's parents, it appears, is the primary consideration for natural born citizen status. ...

Supreme Court Dodges The Issue -- Again

Bill Mears -- CNN

The Supreme Court has again cast aside an appeal that raised doubts about Barack Obama's U.S. citizenship. The justices without comment Monday rejected a challenge from Charles Kerchner Jr., a Pennsylvania man who sought a trial in federal court forcing the president to produce documents regarding his birth and citizenship. The linked story incorrectly states that "Obama and his staff produced copies of his birth certificate when he was running for president in 2008." What he produced was not a birth certificate, but a "Certification of Live Birth," a document frequently issued to non-citizens, as described in several articles in the Certifi-Gate pages of MarchReport.com ...

Lawyer: Decision 'Doesn't Mean That This Issue Goes Away'

Brian Fitzpatrick -- World Net Daily

"This decision did not help Mr. Obama," attorney Mario Apuzzo said. "It did not bring legitimacy to his office. Mr. Obama does not have legitimacy of office by the court or by the consensus of the nation, because many people question whether he is a natural born citizen. How does our nation go forward with this kind of result?" "This matter should have been addressed by the media and political parties early in the spring of 2008 during the primaries. It wasn't," wrote retired Navy CDR Charles Kerchner. "Congress should have addressed this when asked and when constitutionally it was required to. It didn't. The courts should have addressed the merits of the questions when appealed to early on. They didn't. Everyone in our system of government chose appeasement over confrontation and punted the ball to someone else. Now it is far worse. The Supreme Court has chosen appeasement and inaction over action and dealing with the issue and questions openly in a court of law under the rules of evidence and law. Our constitutional republic and legal system is now compromised and broken." ...

U.S. Supreme Court Confers On Obama Eligibility

Brian Fitzpatrick -- World Net Daily

The Supreme Court conferred today on whether arguments should be heard on the merits of Kerchner v. Obama, a case challenging whether President Barack Obama is qualified to serve as president because he may not be a "natural-born citizen" as required by Article II, Section 1, Clause 5 of the U.S. Constitution. "This case is unprecedented," said Mario Apuzzo, the attorney bringing the suit. "I believe we presented an ironclad case. We've shown standing, and we've shown the importance of the issue for the Supreme Court. There's nothing standing in their way to grant us a writ of certiorari." If the Supreme Court decides to grant the "writ of certiorari," it may direct a federal trial court in New Jersey to hear the merits of the case, or it may choose to hear the merits itself. ...

Birth Certificate Bill Filed For Presidential Candidates

Terry Greenberg -- Lubbock Avalanche Journal

A Texas state representative on Tuesday filed a bill that would require any candidate for president or vice president of the United States to show his or her birth certificate to the Texas secretary of state, another indication of just how ambitious the conservative agenda for next year's session of the Texas Legislature is expected to be. "This bill is necessary because we have a president whom the American people don't know whether he was born in Kenya or some other place," Rep. Leo Berman, R-Tyler, said in reference to President Barack Obama and of House Bill 295. "If you are running for president or vice president, you've got to show here in Texas that you were born in the United States and the birth certificate is your proof." ...

Congressional Report Concedes That Obama Eligibility Was Unvetted

Jerome R. Corsi -- World Net Daily

The analysis by the Congressional Research Service, a research arm of the U.S. Congress, openly admits no one in the federal government, including Congress, ever asked to see Obama's long-form, hospital-generated birth certificate. It explains no one was required to do so. The CRS memorandum, published and distributed to congressional offices April 3, 2009, was written to explain to senators and member of the House how they could answer constituents who were demanding to see Obama's birth certificate. Authored by Jack Maskell, the legislative attorney in the American Law Division of the Congressional Research Service, the document was a memorandum written for the subject "Qualifications for the Office of President of the United States and Legal Challenges to the Eligibility of a Candidate." Maskell explained that he wrote it only for distribution to congressional offices, not for public distribution, and it was not posted on any of the CRS report sites where the public might have been able to find it. ...

Eligibility Attorney Asks To Join Case Before Supreme Court

Bob Unruh -- World Net Daily

A prominent lawyer who has argued several legal challenges to Barack Obama's eligibility to be president, including cases pending at the appeals level in both state and federal courts in California, is asking to join in a case already pending before the U.S. Supreme Court. The request is from Gary Kreep of the United States Justice Foundation to join the appeal by attorney Mario Apuzzo on behalf of his client, Charles Kerchner Jr. Kreep is seeking to file a friend-of-the-court brief on behalf of the Western Center for Journalism in support of Kerchner and the other plaintiffs. The Western Center covers a wide variety of topics and is training "citizen journalists" and bloggers, the request explains. So, the "issue of a candidate for president of the United States not being required to conclusively prove his or her birth status is of great concern ... because if the determinations of eligibility are left to the political parties, this will lead to candidates who clearly fail to meet the requirements." ...

New Strategy For Officer Testing Obama's Eligibility:
Are Orders Legal?

Bob Unruh -- World Net Daily

"As a medical officer and not a lawyer or constitutional scholar, LTC Lakin is not laying claim to be the sole arbiter of the president's constitutionality in attempting to determine, without any genuine evidence to make such a determination, the president's 'natural born' citizen status," the The American Patriot Foundation said. "The burden of proof rests solely on Barack Obama to demonstrate to the American people and to the U.S. armed forces that he commands, that he is lawfully serving in his current capacity as head of the executive branch of the federal government," the foundation said. Army prosecutors, along with the acting judge in the case, Denise Lind, have "made this determination of the commander in chief's eligibility under the Constitution impossible -- by denying discovery -- and essentially denying LTC Lakin the customary due process rights that defendants in American courts enjoy when facing criminal charges," the foundation elaborated. Earlier, the acting judge in the case, Denise Lind, ruled that nothing regarding Obama could be discussed during the trial. She noted at that time providing documentation on the president might prove "embarrassing" for him. ...

Railroading Of Lt. Col. Terrence Lakin Continues

Brian Fitzpatrick -- World Net Daily

An Army judge has made it "impossible" for a career medical officer to get a fair hearing on charges he refused to deploy to Afghanistan because of concern that obeying orders in the chain of command under an ineligible commander in chief would be illegal, his attorney says. The rulings came today from Col. Denise Lind, who in so many words told Lt. Col. Terrence Lakin to pound sand. Rocks actually. He faces up to four years at hard labor if convicted in his case. "We got absolutely slammed today," said Paul R. Jensen, lead counsel for the defense. "It's impossible for us to have a fair trial under these rulings." In her decision, Lind, acting as judge in the case, censored the last remaining arguments Lakin planned to make in his defense: motive and duty. Lakin had intended to explain his motive for disobeying the order and contend that it was his duty as a good soldier to disobey orders that he believes to be illegal. The defense also planned to call as witnesses Ambassador Alan Keyes and retired Air Force Lt. Gen. Thomas McInerney. Keyes was to explain the constitutional issues involved in the case, and McInerney was to talk about the training soldiers receive regarding when they should question and even disobey orders. ...

Fox News Military Analyst Lt. Gen. Thomas G. McInerney (Ret.) Demands Obama Release His Birth Records

Bob Unruh -- World Net Daily

McInerney, who commanded forces armed with nuclear weapons, says the disclosure of Barack Obama's documentation proving his eligibility to be commander in chief is critical not just to the defense of an officer challenging Obama's status, but to the preservation of the nation itself. The general, who retired in 1994 after serving as vice commander in chief of USAF forces in Europe, commander of the 3rd Tactical Fighter Wing and assistant vice chief of staff of the U.S. Air Force, among other positions, said the chain of command issue is critical in today's world, since officers are obligated both to follow orders and to disobey illegal orders. "There can be no question that it is absolutely essential to good order and discipline in the military that there be no break in the unified chain of command, from the lowliest E-1 up to and including the commander in chief who is under the Constitution, the president of the United States. As military officers, we owe our ultimate loyalty not to superior officers or even to the president, but rather, to the Constitution." ...

Rants & Raves from Our Readers

A reader who wishes to remain anonymous sent in this criticism:

Mr. March, You linked the video of Hillary Clinton having what has been referred to as an 'outburst' on your site, yet, you did not explain the context. You omitted the truth and presented the situation as another crazy Clinton moment. You not only misportrayed the situation, you lost an opportunity to share/address the plight of women who have no rights in their country. I have been a long time reader of your March Report and have shared the Report with many people. I wrote to you addressing the Clinton video and have seen no retraction or explanation. I won't be referring anyone to this page anymore. My belief and trust that you maintain objectivity and research all sides has been permanently altered recently. Consevative or not, you have always seemed to work at being fair and true to journalism. I now am seeing you differently.

    Robert Jay March Responds:

This reader has mischaracterized the report. In fact, we went out of way to add clarity to the situation. The copy proved by WMAQ-TV, the televsion station which provide the report through one of our syndicators, said "A Congolese university student seems to presume that Bill Clinton's opinion is more important than the current Secretary of State's." In order to portray the situation accurately, we rewrote the copy to read as follows (emphasis added): "As a result of a translator's error, a Congolese university student appears to presume that Bill Clinton's opinion is more important than the current Secretary of State's. Hillary explodes, and hilarity ensues. Oh, those wacky, wacky Clintons." That was all the information that was available on August 11, 2009, when we ran the story. Witty retort aside, we went out of our way to clarify the report. Further details from the State Department and the White House did not become available until the following day.

Another reader, who wish to be referred to by the nom de plume "Needles," has an unusual take on the Certifi-Gate crisis:

The birthers need to step back and consider the consequences of their actions. If Mr. Obama were to be declared ineligible, there are several possible outcomes. They could remove him from office and install Joe Biden as President. The argument would be made that if Mr. Obama was not eligible to run for President, then the ticket is invalid as well and Joe Biden should not be Vice President. The next person in the order of succession would be Speaker of the House; Nancy Pelosi. Because no eligible candidate received a majority of electoral votes, the selection of the President could be thrown into the House. Speaker Nancy Pelosi, would then be king-maker. The choices are Joe Biden, Nancy Pelosi or someone Nancy Pelosi picks. Maybe it is best to leave the birth certificate matter alone.

    Robert Jay March Responds:

Mr. Obama being declared ineligible does not legally invalidate Biden's election, provided he is qualified. Even if it did, the Constitution is too important to ignore; it is all that separates us from tyranny. Regardless of the consequences, if in fact Mr. Obama is ineligible, he must be removed. That said, all we have thus far is the preponderance of evidence leading to a likely conclusion, not conclusive facts. That is why the revelation of the long-form birth certificate is so important.

Finally, a third reader who wish to be referred to by the nom de plume "unihawker," writes:

Dear Mr. March, I was watching TV the other night and they showed a clip of Obama in Kenya during his trip there during the campaign. I am not sure if it was just some Freudian slip or not, but he said as he was waiving to the people greeting him, "Thank you, it is great to be back home". My question was, If he was not born in that country why would he call it home?

    Robert Jay March Responds:

Good question, for which I have no answer. If this report is correct, it is yet another contribution to the preponderance of evidence that implies Mr. Obama is ineligible. A copy of the long form birth certificate would cost Mr. Obama $12; thus far he has spent $1.3 Million to avoid producing it. As in any investigation, follow the money: in this case, what money is being spent on to conceal.
