The Battles For Late Night

The Leno-O'Brien debacle might not have happened if Jay Leno had used representation. As Bill Carter tells the story in his hugely entertaining recap, The War for Late Night: When Leno Went Early and Television Went Crazy, Leno fired his manager in 1992, shortly after taking over from Johnny Carson as host of the "Tonight Show." Leno believed that his manager had said things to poison his relationship with Carson. As it was, David Letterman, who, as the host of "Late Night," had been following Carson for eleven years and was considered the heir apparent, felt resentment about being passed over for Leno, whose reputation had been built partly on his many guest appearances on "Late Night." Leno was professional to the core, but he did not want business to ruin friendship. He never used a manager or an agent for his contract renewals again.

Bush: 'Damn Right' I Gave The Go-Ahead On Waterboarding Terror Suspect

Bush's new memoir, Decision Points, the former president explains that the CIA approached him about the possibility of waterboarding Khalid Sheikh Mohammed, the al-Qaeda operative often called "the architect of 9/11." In his memoir, Bush writes that his response was "Damn right." This seems to be a straightforward admission that Bush approved the use of waterboarding on a detainee--even though this technique is widely regarded as inhumane, and its use is thought by many to violate the United Nations Convention Against Torture, of which the United States is a signatory. (In media outside the U.S., waterboarding is almost always referred to as torture.)

Peter Hitchens Talks About His Faith And His Atheist Sibling Christopher

Almost everyone knows how his elder brother Christopher Hitchens feels, but less well known are the views of Peter Hitchens, a conservative columnist for the The Mail on Sunday in London, who was inspired to write his latest book, The Rage Against God: How Atheism Led Me to Faith, because of the "dangerous" teachings of men like his brother. It is not a faith book, at least not in the conventional sense of defending doctrine or even making a philosophical case for God. The book is devoid of "faith talk"; the name Jesus does not appear once in the book. "Remember, I'm an ex-Trotskyite, so I'm quite suspicious of the man of total conviction and certainty. What I did not want, coming away from Marxist utopianism, was to find another mirror image of utopianism," he said. "The argument I'm making for religion is largely a negative one: if you get rid of [God] you will be in a tremendous fix."

Fight Over Evolution Still Simmers 85 Years After Scopes Trial

Rachel Held Evans had a choice while growing up in Dayton, Tenn., site of the 1925 Scopes Monkey Trial. Believe the Bible or believe evolution. "I was taught that if you don't interpret Genesis 1 and 2 literally, then you don't take the Bible seriously," said Evans, 29. "I held on tightly to that for a long time." Evans says creationism -- the belief that God created the Earth around 6,000 years ago in six days -- was commonplace in her town. Unable to reconcile science with her faith, Evans embraced evolution. "I learned you don't have to choose between loving and following Jesus and believing in evolution," she said. She chronicled her personal journey in a new memoir, Evolving in Monkey Town: How a Girl Who Knew All the Answers Learned to Ask the Questions.

 'Death Panels' Controversy: Is Obama Avoiding Congress?

In a move that could resuscitate the partisan battle over what Sarah Palin dubbed "death panels," the Obama administration is set to implement a controversial federal health-care provision by executive authority. A similar provision was dropped from the health insurance reform package in 2009 after Palin's "death panels" comment stoked a public backlash. Critics charge that the new regulations are an end run around the Congress, putting into rules an approach that was rejected by lawmakers. "We're very concerned that this new regulation is importing something into the law that the Congress clearly did not include," says David Christensen, senior director of congressional affairs for the Family Research Council, a faith-based advocacy group. "Congress initially looked at this and decided to not include it as part of the new health-care law." ...

How, for instance, to pass a secret message to a field operative without danger of interception? Republican Senate candidate Joe Miller announced late Sunday that he would continue his challenge in federal court of the write-in election of rival Sen. Lisa Murkowski, but added he would not oppose certification of Murkowski's victory by state election officials. U.S. District Court Judge Ralph Beistline, who is hearing Miller's federal challenge, had already said he would probably lift his order staying certification, allowing Murkowski to assume office Jan. 5 without losing seniority or leaving the state short a U.S. Senator. In a prepared statement e-mailed to the media about 10:20 p.m., Miller said he planned to go ahead with his federal lawsuit "for the sake of the integrity of the election." ...

Barack Obama's decision last week to reverse U.S. policy and back a U.N. declaration on the rights of "indigenous peoples" has touched off a debate on whether the move could boost American Indian legal claims over the ills they suffered dating back to the colonial period. John Bolton, the former U.S. ambassador to the United Nations, said the "abstract" document -- which in several sections discusses the "right to redress" -- will probably be used to fuel new legal claims. And he predicted the issue would complicate those cases more than it would help either side actually resolve them. Armstrong Wiggins, director of the Indian Law Resource Center's Washington, D.C., office, said compensation may still be in order as the tribes negotiate with the government, given that their rights to land and resources are of paramount concern. "We are not saying that native people are going to take back New York City." ...

Little Fockersled the box office over the three-day Christmas weekend, taking in a healthy $34 million, according to studio estimates. 'Gulliver's Travels' Review: Jack Black Stars In Misguided Remake Of A Classic

Some books are too adult for grown-ups -- and so they're quickly turned into stories for children. After all, it's safer to think that "Frankenstein, or The Modern Prometheus" is only about a mad doctor or that "Alice's Adventures in Wonderland" is about a mad tea party than to deal with their pointed critiques of morals, history and society. Better juvenile than Juvenal -- and so Jonathan Swift's "Gulliver's Travels" was long ago stripped of its comments on religious intolerance and political idiocy to become a nursery tale, concerning only a shipwrecked sailor and some tiny, cutely bellicose natives. Meteorologist Piers Corbyn seems to get it right about 85 per cent of the time and serious business people (notably in farming) are starting to invest in his forecasts. He looks at the flow of particles from the Sun, and how they interact with the upper atmosphere, especially air currents such as the jet stream, and he looks at how the Moon and other factors influence those streaming particles. He takes a snapshot of what the Sun is doing at any given moment, and then he looks back at the record to see when it last did something similar. Then he checks what the weather was like on Earth at the time, and he makes a prophecy. Piers Corbyn believes that the last three winters could be the harbinger of a mini ice age that could be upon us by 2035, and that it could start to be colder than at any time in the last 200 years. He goes on to speculate that a genuine ice age might then settle in, since an ice age is now cyclically overdue. ...

It is time for the U.S. government to acknowledge that a climate mafia has existed since the gathering in Kyoto, Japan, to establish the United Nations Framework Convention on Climate Change. The December 11, 1997 treaty was, upon ratification, to go into force on February 16, 2005. Its expressed purpose was to reduce greenhouse gas (GHG) emissions for the purpose of avoiding "global warming," but its real purpose was to create an entirely bogus system of emissions trading to be known as "the carbon market." On July 25, 1997, the U.S. Senate, responsible for the ratification of international treaties, unanimously passed (95-0) a resolution rejecting the Kyoto Treaty on the grounds that it "would result in serious harm to the economy of the United States." As this is written, the U.S. Environmental Protection Agency is striving to secure authorization to regulate GHG emissions despite massive evidence that they pose no threat to the environment and despite the fact that this authority would, as in 1997, cripple and likely destroy an already ailing economy. ...

A new report by China analysts Andrew Erickson and Gabe Collins says: 'Beijing has successfully developed, tested, and deployed the world's first weapons system capable of targeting a moving carrier strike group (CSG) from long-range, land-based mobile launchers. The Second Artillery, China's strategic missile force, already has a capability to attempt to use the DF-21D against US CSGs in the event of conflict, and therefore likely expects to achieve a growing degree of deterrence with it.' The report also notes the significant potential in terms of firing distance of the mainland-based missiles, which bring targets well past the first island chain and Taiwan -- including the US Navy base in Guam -- within range. ...

Khodorkovsky spent time lost in thought and staring at the floor, while Lebedev read a thick book and even burst out laughing once as the judge described Yukos' alleged machinations. Vadim Klyuvgant, a lawyer for Khodorkovsky, said outside the courthouse that the defense would appeal regardless of the actual sentence. "What we hear now leaves no doubt that pressure was put on the court," he told reporters. Washington has not witnessed so much top level White House intrigue since October 20, 1973, when a Saturday night saw President Nixon fire the Watergate independent counsel, the U.S. attorney general, and the deputy attorney general in the "Saturday Night Massacre." Just ten days earlier, Vice President Spiro Agnew resigned after being charged with accepting bribes while governor of Maryland. In the case of Barack Obama, the senior firings are not happening during a single nght but the recent involuntary sudden departures of the White House chief of staff and national security adviser, along with what is a putative president who is suffering from Nixonian levels of paranoia, depression, and schizophrenia, has some top-level administration officials considering the first-ever invocation of Section 4 of the 25th Amendment -- the involuntary removal of the president from office. The Arizona law reflects the same language as the wording in federal immigration law. The state law doesn't create its own immigration policy. That makes the administration's legal challenge all the more specious. Obama, a case challenging whether President Barack Obama is qualified to serve as president because he may not be a "natural-born citizen" as required by Article II, Section 1, Clause 5 of the U.S. Constitution. "This case is unprecedented," said Mario Apuzzo, the attorney bringing the suit. "I believe we presented an ironclad case. We've shown standing, and we've shown the importance of the issue for the Supreme Court. There's nothing standing in their way to grant us a writ of certiorari." If the Supreme Court decides to grant the "writ of certiorari," it may direct a federal trial court in New Jersey to hear the merits of the case, or it may choose to hear the merits itself. ...

Congressional Report Concedes That Obama Eligibility Was Unvetted

The analysis by the Congressional Research Service, a research arm of the U.S. Congress, openly admits no one in the federal government, including Congress, ever asked to see Obama's long-form, hospital-generated birth certificate. It explains no one was required to do so. The CRS memorandum, published and distributed to congressional offices April 3, 2009, was written to explain to senators and member of the House how they could answer constituents who were demanding to see Obama's birth certificate. Authored by Jack Maskell, the legislative attorney in the American Law Division of the Congressional Research Service, the document was a memorandum written for the subject "Qualifications for the Office of President of the United States and Legal Challenges to the Eligibility of a Candidate." Maskell explained that he wrote it only for distribution to congressional offices, not for public distribution, and it was not posted on any of the CRS report sites where the public might have been able to find it. ...

Eligibility Attorney Asks To Join Case Before Supreme Court

A prominent lawyer who has argued several legal challenges to Barack Obama's eligibility to be president, including cases pending at the appeals level in both state and federal courts in California, is asking to join in a case already pending before the U.S. Supreme Court. The request is from Gary Kreep of the United States Justice Foundation to join the appeal by attorney Mario Apuzzo on behalf of his client, Charles Kerchner Jr. Kreep is seeking to file a friend-of-the-court brief on behalf of the Western Center for Journalism in support of Kerchner and the other plaintiffs. The Western Center covers a wide variety of topics and is training "citizen journalists" and bloggers, the request explains. So, the "issue of a candidate for president of the United States not being required to conclusively prove his or her birth status is of great concern ... because if the determinations of eligibility are left to the political parties, this will lead to candidates who clearly fail to meet the requirements." ...

Army prosecutors, along with the acting judge in the case, Denise Lind, have "made this determination of the commander in chief's eligibility under the Constitution impossible -- by denying discovery -- and essentially denying LTC Lakin the customary due process rights that defendants in American courts enjoy when facing criminal charges," the foundation elaborated. Earlier, the acting judge in the case, Denise Lind, ruled that nothing regarding Obama could be discussed during the trial. She noted at that time providing documentation on the president might prove "embarrassing" for him. ...

An Army judge has made it "impossible" for a career medical officer to get a fair hearing on charges he refused to deploy to Afghanistan because of concern that obeying orders in the chain of command under an ineligible commander in chief would be illegal, his attorney says. The rulings came today from Col. Denise Lind, who in so many words told Lt. Col. Terrence Lakin to pound sand. Rocks actually. He faces up to four years at hard labor if convicted in his case. "We got absolutely slammed today," said Paul R. Jensen, lead counsel for the defense. "It's impossible for us to have a fair trial under these rulings." In her decision, Lind, acting as judge in the case, censored the last remaining arguments Lakin planned to make in his defense: motive and duty. Lakin had intended to explain his motive for disobeying the order and contend that it was his duty as a good soldier to disobey orders that he believes to be illegal. The defense also planned to call as witnesses Ambassador Alan Keyes and retired Air Force Lt. Gen. Thomas McInerney. Keyes was to explain the constitutional issues involved in the case, and McInerney was to talk about the training soldiers receive regarding when they should question and even disobey orders. ...

    A reader who wishes to remain anonymous sent in this criticism:

    Mr. March, You linked the video of Hillary Clinton having what has been referred to as an 'outburst' on your site, yet, you did not explain the context. You omitted the truth and presented the situation as another crazy Clinton moment. You not only misportrayed the situation, you lost an opportunity to share/address the plight of women who have no rights in their country. I have been a long time reader of your March Report and have shared the Report with many people. I wrote to you addressing the Clinton video and have seen no retraction or explanation. I won't be referring anyone to this page anymore. My belief and trust that you maintain objectivity and research all sides has been permanently altered recently. Consevative or not, you have always seemed to work at being fair and true to journalism. I now am seeing you differently.

    Robert Jay March Responds:

    This reader has mischaracterized the report. In fact, we went out of way to add clarity to the situation. The copy proved by WMAQ-TV, the televsion station which provide the report through one of our syndicators, said "A Congolese university student seems to presume that Bill Clinton's opinion is more important than the current Secretary of State's." In order to portray the situation accurately, we rewrote the copy to read as follows (emphasis added): "As a result of a translator's error, a Congolese university student appears to presume that Bill Clinton's opinion is more important than the current Secretary of State's. Hillary explodes, and hilarity ensues. Oh, those wacky, wacky Clintons." That was all the information that was available on August 11, 2009, when we ran the story. Witty retort aside, we went out of our way to clarify the report. Further details from the State Department and the White House did not become available until the following day.

    Another reader, who wish to be referred to by the nom de plume "Needles," has an unusual take on the Certifi-Gate crisis:

    The birthers need to step back and consider the consequences of their actions. If Mr. Obama were to be declared ineligible, there are several possible outcomes. They could remove him from office and install Joe Biden as President. The argument would be made that if Mr. Obama was not eligible to run for President, then the ticket is invalid as well and Joe Biden should not be Vice President. The next person in the order of succession would be Speaker of the House; Nancy Pelosi. Because no eligible candidate received a majority of electoral votes, the selection of the President could be thrown into the House. Speaker Nancy Pelosi, would then be king-maker. The choices are Joe Biden, Nancy Pelosi or someone Nancy Pelosi picks. Maybe it is best to leave the birth certificate matter alone.

    Robert Jay March Responds:

    Mr. Obama being declared ineligible does not legally invalidate Biden's election, provided he is qualified. Even if it did, the Constitution is too important to ignore; it is all that separates us from tyranny. Regardless of the consequences, if in fact Mr. Obama is ineligible, he must be removed. That said, all we have thus far is the preponderance of evidence leading to a likely conclusion, not conclusive facts. That is why the revelation of the long-form birth certificate is so important.

    Finally, a third reader who wish to be referred to by the nom de plume "unihawker," writes:

    Dear Mr. March, I was watching TV the other night and they showed a clip of Obama in Kenya during his trip there during the campaign. I am not sure if it was just some Freudian slip or not, but he said as he was waiving to the people greeting him, "Thank you, it is great to be back home". My question was, If he was not born in that country why would he call it home?

    Robert Jay March Responds:

    Good question, for which I have no answer. If this report is correct, it is yet another contribution to the preponderance of evidence that implies Mr. Obama is ineligible. A copy of the long form birth certificate would cost Mr. Obama $12; thus far he has spent $1.3 Million to avoid producing it. As in any investigation, follow the money: in this case, what money is being spent on to conceal.
