The Battles For Late Night

The Leno-O'Brien debacle might not have happened if Jay Leno had used representation. As Bill Carter tells the story in his hugely entertaining recap, The War for Late Night: When Leno Went Early and Television Went Crazy, Leno fired his manager in 1992, shortly after taking over from Johnny Carson as host of the "Tonight Show." Leno believed that his manager had said things to poison his relationship with Carson. As it was, David Letterman, who, as the host of "Late Night," had been following Carson for eleven years and was considered the heir apparent, felt resentment about being passed over for Leno, whose reputation had been built partly on his many guest appearances on "Late Night." Leno was professional to the core, but he did not want business to ruin friendship. He never used a manager or an agent for his contract renewals again.

Bush: 'Damn Right' I Gave The Go-Ahead On Waterboarding Terror Suspect

In George W. Bush's new memoir, Decision Points, the former president explains that the CIA approached him about the possibility of waterboarding Khalid Sheikh Mohammed, the al-Qaeda operative often called "the architect of 9/11." In his memoir, Bush writes that his response was "Damn right." This seems to be a straightforward admission that Bush approved the use of waterboarding on a detainee--even though this technique is widely regarded as inhumane, and its use is thought by many to violate the United Nations Convention Against Torture, of which the United States is a signatory. (In media outside the U.S., waterboarding is almost always referred to as torture.)

Peter Hitchens Talks About His Faith And His Atheist Sibling Christopher

Almost everyone knows how his elder brother Christopher Hitchens feels, but less well known are the views of Peter Hitchens, a conservative columnist for the The Mail on Sunday in London, who was inspired to write his latest book, The Rage Against God: How Atheism Led Me to Faith, because of the "dangerous" teachings of men like his brother. It is not a faith book, at least not in the conventional sense of defending doctrine or even making a philosophical case for God. The book is devoid of "faith talk"; the name Jesus does not appear once in the book. "Remember, I'm an ex-Trotskyite, so I'm quite suspicious of the man of total conviction and certainty. What I did not want, coming away from Marxist utopianism, was to find another mirror image of utopianism," he said. "The argument I'm making for religion is largely a negative one: if you get rid of [God] you will be in a tremendous fix."

Fight Over Evolution Still Simmers 85 Years After Scopes Trial

Rachel Held Evans had a choice while growing up in Dayton, Tenn., site of the 1925 Scopes Monkey Trial. Believe the Bible or believe evolution. "I was taught that if you don't interpret Genesis 1 and 2 literally, then you don't take the Bible seriously," said Evans, 29. "I held on tightly to that for a long time." Evans says creationism -- the belief that God created the Earth around 6,000 years ago in six days -- was commonplace in her town. Unable to reconcile science with her faith, Evans embraced evolution. "I learned you don't have to choose between loving and following Jesus and believing in evolution," she said. She chronicled her personal journey in a new memoir, Evolving in Monkey Town: How a Girl Who Knew All the Answers Learned to Ask the Questions.

 Missing Woman Identified Attacker In Frantic 911 Call Before Disappearance

The first of the decomposed bodies was discovered several feet from Ocean Parkway between Cedar Beach and West Gilgo Beach Saturday at 2:45 p.m., and three bodies were discovered Monday within a quarter of a mile of each otherl. "We were searching to see if [Shannon Maria Gilbert's] remains were in area," said Suffolk County Police Detective. Lt. Gerard Pelkofsky. "We found these four sets of remains. It is really undetermined if she is one of the victims or not." Police believe the bodies may have been killed in another location before being dumped out of a car onto the beach. Suffolk County Police Commissioner Richard Dormer said at a press conference, "I don't think it's a coincidence that four bodies ended up in this area." He said the police are considering the possibility that these bodies were the victims of a serial killer. Police say Gilbert even specifically named her attacker, who was someone she knew. ...

Repeal supporters insisted they have the 60 Senate votes they need, and maybe more, to defeat a Republican filibuster. They are relying on public commitments from Maine Republican Sens. Susan Collins, who broke ranks with her party on a repeal vote last week, and Olympia Snowe, who said Wednesday she would vote yes; and Scott Brown of Massachusetts or Lisa Murkowski of Alaska. Brown and Murkowski issued statements this month that cited an exhaustive 10-month Pentagon study, released Nov. 30, that said repeal would not harm the military. A 1,924-page "omnibus" bill to fund the government is headed for a Senate vote that will put lawmakers from both parties on the spot over the practice of earmarking money for projects. The $1.2 trillion measure, unveiled by Democrats today, includes thousands of earmarks and comes about a month after Republicans adopted a non-binding moratorium on pushing for such projects. The Senate's Democratic majority aims to overcome that objection with the help of Republicans such as Senators George Voinovich of Ohio and Bob Bennett of Utah who scoff at complaints over the projects. Senator Jim DeMint, a South Carolina Republican, urged his colleagues to deny Democrats the votes needed to advance the bill that finances government agencies and programs for the fiscal year that ends Sept. 30, 2011. Fellow South Carolina Republican Senator Lindsey Graham called the impending vote a "defining moment" for his party, one that will be closely watched by some voters. "This represents the old way of doing business," he said. ...

The plan, negotiated by Obama administration and GOP officials, would extend all Bush-era tax cuts, first enacted in 2001 and 2003, for two years. It also would cut the Social Security payroll tax for workers by 2 percentage points next year and provide 13 months of jobless benefits for the long-term unemployed. Huge Solar Explosions Can Rock The Entire Sun

Violent explosions on the sun erupt on a phenomenal scale -- one that envelopes the entire star -- and are linked by massive magnetic threads that stretch across hundreds of thousands of miles, a new study finds. Solar flares, coronal mass ejections and other dramatic solar storms can go off all at once across virtually the entire sun, a team of researchers announced Dec. 13. The discovery suggests scientists should expand their studies of space weather to go beyond looking just at isolated parts of the sun, as has been common in the past. "To predict eruptions, we can no longer focus on the magnetic fields of isolated active regions," said study co-author Alan Title of Stanford University and Lockheed-Martin's Advanced Technology Center in Palo Alto, Calif., in a statement. "We have to know the surface magnetic field of practically the entire sun." ...

 U.S. Long-Range Missile Defense Test Fails In The Pacific

A missile-defense interceptor missed its target during Wednesday's $120 million test at Vandenberg Air Force Base, giving the program a second failed test this year. Shortly after noon, the Ground-Based Interceptor popped out of an underground silo on north Vandenberg, quickly disappearing into cloudy skies en route toward the target high above the Pacific Ocean. Less than two hours later, officials confirmed that an intercept wasn't achieved. "The Sea Based X-Band radar (SBX) and all sensors performed as planned. The Ground Based Interceptor (GBI) was launched and successfully deployed an Exoatmospheric Kill Vehicle (EKV)," the Missile Defense Agency's statement said. "Program officials will conduct an extensive investigation to determine the cause of the failure to intercept the target. The next flight test will be determined after identification of the cause of the failure." ...

It is time for the U.S. government to acknowledge that a climate mafia has existed since the gathering in Kyoto, Japan, to establish the United Nations Framework Convention on Climate Change. The December 11, 1997 treaty was, upon ratification, to go into force on February 16, 2005. Its expressed purpose was to reduce greenhouse gas (GHG) emissions for the purpose of avoiding "global warming," but its real purpose was to create an entirely bogus system of emissions trading to be known as "the carbon market." On July 25, 1997, the U.S. Senate, responsible for the ratification of international treaties, unanimously passed (95-0) a resolution rejecting the Kyoto Treaty on the grounds that it "would result in serious harm to the economy of the United States." As this is written, the U.S. Environmental Protection Agency is striving to secure authorization to regulate GHG emissions despite massive evidence that they pose no threat to the environment and despite the fact that this authority would, as in 1997, cripple and likely destroy an already ailing economy. ...

Mr Assange, who is being held in Wandsworth prison in south London has been given permission to appear in court as Mr Justice Ouseley decides whether to uphold an earlier court decision to grant him bail subject to certain conditions. On Tuesday district judge Howard Riddle said he would grant Mr Assange bail provided that he was fitted with an electronic tag, would be resident at Ellingham Hall, a stately home in Suffolk, and would report to a nearby police station daily. ...

According to the Swedish branch of Interpol, a recent arrest warrant for Assange states that the rape accusation stems from a sexual encounter in which the woman "was asleep and in a helpless state." No one could have predicted Assange's becoming one of Sweden's most wanted when he traveled to the country in August to hold a series of lectures on WikiLeaks and received a rapturous welcome. According to Thomas Mattsson, editor of the Swedish daily Expressen, the nation's affinity for Assange came naturally: Swedes share his love of technology and his belief in open government. But Mattsson says Swedes also have another passion which is equally important. "We are very moral in terms of how well-known and powerful men may behave with women in all kinds situations, romantically or professionally," he says. ...

The Arizona law reflects the same language as the wording in federal immigration law. The state law doesn't create its own immigration policy. That makes the administration's legal challenge all the more specious. Its arguments parrot those the ACLU, the National Council of La Raza and similar activist groups make whenever a state or locality tries to enact a remedy to immigration-related problems that arise in their community. The Supreme Court and several appellate courts have treaded lightly in cases involving federal pre-emption. The justices without comment Monday rejected a challenge from Charles Kerchner Jr., a Pennsylvania man who sought a trial in federal court forcing the president to produce documents regarding his birth and citizenship. The linked story incorrectly states that "Obama and his staff produced copies of his birth certificate when he was running for president in 2008." The Supreme Court conferred today on whether arguments should be heard on the merits of Kerchner v. Obama, a case challenging whether President Barack Obama is qualified to serve as president because he may not be a "natural-born citizen" as required by Article II, Section 1, Clause 5 of the U.S. Constitution. "This case is unprecedented," said Mario Apuzzo, the attorney bringing the suit. "I believe we presented an ironclad case. We've shown standing, and we've shown the importance of the issue for the Supreme Court. There's nothing standing in their way to grant us a writ of certiorari." If the Supreme Court decides to grant the "writ of certiorari," it may direct a federal trial court in New Jersey to hear the merits of the case, or it may choose to hear the merits itself. ...

Congressional Report Concedes That Obama Eligibility Was Unvetted

The analysis by the Congressional Research Service, a research arm of the U.S. Congress, openly admits no one in the federal government, including Congress, ever asked to see Obama's long-form, hospital-generated birth certificate. It explains no one was required to do so. The CRS memorandum, published and distributed to congressional offices April 3, 2009, was written to explain to senators and member of the House how they could answer constituents who were demanding to see Obama's birth certificate. Authored by Jack Maskell, the legislative attorney in the American Law Division of the Congressional Research Service, the document was a memorandum written for the subject "Qualifications for the Office of President of the United States and Legal Challenges to the Eligibility of a Candidate." Maskell explained that he wrote it only for distribution to congressional offices, not for public distribution, and it was not posted on any of the CRS report sites where the public might have been able to find it. ...

Eligibility Attorney Asks To Join Case Before Supreme Court

A prominent lawyer who has argued several legal challenges to Barack Obama's eligibility to be president, including cases pending at the appeals level in both state and federal courts in California, is asking to join in a case already pending before the U.S. Supreme Court. The request is from Gary Kreep of the United States Justice Foundation to join the appeal by attorney Mario Apuzzo on behalf of his client, Charles Kerchner Jr. Kreep is seeking to file a friend-of-the-court brief on behalf of the Western Center for Journalism in support of Kerchner and the other plaintiffs. The Western Center covers a wide variety of topics and is training "citizen journalists" and bloggers, the request explains. So, the "issue of a candidate for president of the United States not being required to conclusively prove his or her birth status is of great concern ... because if the determinations of eligibility are left to the political parties, this will lead to candidates who clearly fail to meet the requirements." ...

Army prosecutors, along with the acting judge in the case, Denise Lind, have "made this determination of the commander in chief's eligibility under the Constitution impossible -- by denying discovery -- and essentially denying LTC Lakin the customary due process rights that defendants in American courts enjoy when facing criminal charges," the foundation elaborated. Earlier, the acting judge in the case, Denise Lind, ruled that nothing regarding Obama could be discussed during the trial. She noted at that time providing documentation on the president might prove "embarrassing" for him. ...

An Army judge has made it "impossible" for a career medical officer to get a fair hearing on charges he refused to deploy to Afghanistan because of concern that obeying orders in the chain of command under an ineligible commander in chief would be illegal, his attorney says. The rulings came today from Col. Denise Lind, who in so many words told Lt. Col. Terrence Lakin to pound sand. Rocks actually. He faces up to four years at hard labor if convicted in his case. "We got absolutely slammed today," said Paul R. Jensen, lead counsel for the defense. "It's impossible for us to have a fair trial under these rulings." In her decision, Lind, acting as judge in the case, censored the last remaining arguments Lakin planned to make in his defense: motive and duty. Lakin had intended to explain his motive for disobeying the order and contend that it was his duty as a good soldier to disobey orders that he believes to be illegal. The defense also planned to call as witnesses Ambassador Alan Keyes and retired Air Force Lt. Gen. Thomas McInerney. Keyes was to explain the constitutional issues involved in the case, and McInerney was to talk about the training soldiers receive regarding when they should question and even disobey orders. ...

    A reader who wishes to remain anonymous sent in this criticism:

    Mr. March, You linked the video of Hillary Clinton having what has been referred to as an 'outburst' on your site, yet, you did not explain the context. You omitted the truth and presented the situation as another crazy Clinton moment. You not only misportrayed the situation, you lost an opportunity to share/address the plight of women who have no rights in their country. I have been a long time reader of your March Report and have shared the Report with many people. I wrote to you addressing the Clinton video and have seen no retraction or explanation. I won't be referring anyone to this page anymore. My belief and trust that you maintain objectivity and research all sides has been permanently altered recently. Consevative or not, you have always seemed to work at being fair and true to journalism. I now am seeing you differently.

    Robert Jay March Responds:

    This reader has mischaracterized the report. In fact, we went out of way to add clarity to the situation. The copy proved by WMAQ-TV, the televsion station which provide the report through one of our syndicators, said "A Congolese university student seems to presume that Bill Clinton's opinion is more important than the current Secretary of State's." In order to portray the situation accurately, we rewrote the copy to read as follows (emphasis added): "As a result of a translator's error, a Congolese university student appears to presume that Bill Clinton's opinion is more important than the current Secretary of State's. Hillary explodes, and hilarity ensues. Oh, those wacky, wacky Clintons." That was all the information that was available on August 11, 2009, when we ran the story. Witty retort aside, we went out of our way to clarify the report. Further details from the State Department and the White House did not become available until the following day.

    Another reader, who wish to be referred to by the nom de plume "Needles," has an unusual take on the Certifi-Gate crisis:

    The birthers need to step back and consider the consequences of their actions. If Mr. Obama were to be declared ineligible, there are several possible outcomes. They could remove him from office and install Joe Biden as President. The argument would be made that if Mr. Obama was not eligible to run for President, then the ticket is invalid as well and Joe Biden should not be Vice President. The next person in the order of succession would be Speaker of the House; Nancy Pelosi. Because no eligible candidate received a majority of electoral votes, the selection of the President could be thrown into the House. Speaker Nancy Pelosi, would then be king-maker. The choices are Joe Biden, Nancy Pelosi or someone Nancy Pelosi picks. Maybe it is best to leave the birth certificate matter alone.

    Robert Jay March Responds:

    Mr. Obama being declared ineligible does not legally invalidate Biden's election, provided he is qualified. Even if it did, the Constitution is too important to ignore; it is all that separates us from tyranny. Regardless of the consequences, if in fact Mr. Obama is ineligible, he must be removed. That said, all we have thus far is the preponderance of evidence leading to a likely conclusion, not conclusive facts. That is why the revelation of the long-form birth certificate is so important.

    Finally, a third reader who wish to be referred to by the nom de plume "unihawker," writes:

    Dear Mr. March, I was watching TV the other night and they showed a clip of Obama in Kenya during his trip there during the campaign. I am not sure if it was just some Freudian slip or not, but he said as he was waiving to the people greeting him, "Thank you, it is great to be back home". My question was, If he was not born in that country why would he call it home?

    Robert Jay March Responds:

    Good question, for which I have no answer. If this report is correct, it is yet another contribution to the preponderance of evidence that implies Mr. Obama is ineligible. A copy of the long form birth certificate would cost Mr. Obama $12; thus far he has spent $1.3 Million to avoid producing it. As in any investigation, follow the money: in this case, what money is being spent on to conceal.
