"As a medical officer and not a lawyer or constitutional scholar, LTC Lakin is not laying claim to be the sole arbiter of the president's constitutionality in attempting to determine, without any genuine evidence to make such a determination, the president's 'natural born' citizen status," the The American Patriot Foundation said. "The burden of proof rests solely on Barack Obama to demonstrate to the American people and to the U.S. armed forces that he commands, that he is lawfully serving in his current capacity as head of the executive branch of the federal government," the foundation said. Army prosecutors, along with the acting judge in the case, Denise Lind, have "made this determination of the commander in chief's eligibility under the Constitution impossible -- by denying discovery -- and essentially denying LTC Lakin the customary due process rights that defendants in American courts enjoy when facing criminal charges," the foundation elaborated. Earlier, the acting judge in the case, Denise Lind, ruled that nothing regarding Obama could be discussed during the trial. She noted at that time providing documentation on the president might prove "embarrassing" for him. ...

An Army judge has made it "impossible" for a career medical officer to get a fair hearing on charges he refused to deploy to Afghanistan because of concern that obeying orders in the chain of command under an ineligible commander in chief would be illegal, his attorney says. The rulings came today from Col. Denise Lind, who in so many words told Lt. Col. Terrence Lakin to pound sand. Rocks actually. He faces up to four years at hard labor if convicted in his case. "We got absolutely slammed today," said Paul R. Jensen, lead counsel for the defense. "It's impossible for us to have a fair trial under these rulings." In her decision, Lind, acting as judge in the case, censored the last remaining arguments Lakin planned to make in his defense: motive and duty. Lakin had intended to explain his motive for disobeying the order and contend that it was his duty as a good soldier to disobey orders that he believes to be illegal. The defense also planned to call as witnesses Ambassador Alan Keyes and retired Air Force Lt. Gen. Thomas McInerney. Keyes was to explain the constitutional issues involved in the case, and McInerney was to talk about the training soldiers receive regarding when they should question and even disobey orders. ...

A military judge in Maryland has refused to order the release of school records that could include a copy of Barack Obama's birth certificate. Lakin's lawyer has argued that if Obama isn't a natural-born citizen, any military order given under his administration is unlawful ...

The general, who retired in 1994 after serving as vice commander in chief of USAF forces in Europe, commander of the 3rd Tactical Fighter Wing and assistant vice chief of staff of the U.S. Air Force, among other positions, said the chain of command issue is critical in today's world, since officers are obligated both to follow orders and to disobey illegal orders. "There can be no question that it is absolutely essential to good order and discipline in the military that there be no break in the unified chain of command, from the lowliest E-1 up to and including the commander in chief who is under the Constitution, the president of the United States. As military officers, we owe our ultimate loyalty not to superior officers or even to the president, but rather, to the Constitution." ...

In fact, its actually a "Certificate of Live Birth" which is a document that does not include all of the information that a birth certificate does, and in Hawaii where such COLBs were provided, one can obtain a COLB without actually having been born there. His grandparents lived in Hawaii at the time of his birth. Was he born in Hawaii? Nobody really knows. He did not spend the $12 to get a long-form copy of the birth certificate which could have been given to any news reporter and the question would no longer exist. ...

Terry Lakin, the Army doctor who is being court martialled for refusing to obey orders has demanded and received a retraction from CNN for defamatory comments that Jeffrey Toobin made about him. "CNN and Toobin did the right thing to clear my name, and while I was ready to file suit if necessary to protect my reputation, I am glad my attorney was successful without having to do so," Lakin said. ...

McNair in Washington, D.C., the court will convene for the purpose of Judge Lind taking Lakin's plea to the charges which consist of "missing movement" and of refusing to obey orders. Lakin stated: "I am not guilty of these charges, and will plead 'not guilty' to them because of my conviction that our Commander-in-Chief may be ineligible under the United States Constitution to serve in that highest of all offices. The truth matters. The Constitution matters. If President Obama is a natural born citizen then the American people deserve to see proof, and if he is not, then I believe the orders in this case were illegal." If convicted, Lakin faces up to four years at hard labor in a federal penitentiary. ...

Last week, in response to a Freedom of Information Act request, the State Department released passport records of Stanley Ann Dunham, Barack Obama's mother, but those records for the years surrounding Obama's 1961 birth are missing. The State Department claims that a 1980s General Services Administration directive had resulted in the destruction of many passport applications and other "non-vital" passport records, including Dunham's 1965 passport application and any other passports she may have applied for or held prior to 1965. Destroyed, then, would also be any records shedding light on whether Dunham did or did not travel out of the country around the time of Barack Obama's birth. ...

 When Lakin demanded that Barack Obama prove that he was legally qualified to act as Commander in Chief of the Armed Forces, his performance evaluation was re-written to incorporate false charges, thus using those false charges in an attempt to prove those false charges. Republican Sen. David Vitter of Louisiana made the comments at a town hall-style event in Metairie, La., on Sunday when a constituent asked what he would do about what the questioner said was Obama's "refusal to produce a valid birth certificate." (The linked article incorrectly states that claims about Obama's birth certificate have been discredited.) But with the crowd applauding the question, Vitter responded that although he doesn't personally have legal standing to bring litigation, he supports "conservative legal organizations and others who would bring that to court," according to a video of the event. ...

First, there is ObamaCare, which violates the Constitutional principle barring the federal government from forcing citizens to purchase something. And no, this is not the same thing as states requiring drivers to purchase car insurance, as some of the intellectually-impaired claim. The Constitution limits FEDERAL government, not state governments, from such things. Second, sources state that the Roberts court has quietly accepted information concerning discrepancies in Obama's history that raise serious questions about his eligibility for the office of President. The charge goes far beyond the birth certificate issue. This information involves possible fraudulent use of a Social Security number in Connecticut, while Obama was a high school student in Hawaii. And that is only the tip of the iceberg. Third, several cases involving possible criminal activity, conflicts of interest, and pay-for-play cronyism could potentially land many Administration officials, if not Obama himself, in hot water with the Court. And finally, the biggie that could potentially send the entire house of cards tumbling in a free-fall is the latest revelation concerning the Obama-Holder Department of Justice and its refusal to pursue the New Black Panther Party. ...

 Hector Maldonado, a Mexican-born naturalized American citizen, Bronze Star awarded US veteran, and Republican candidate for the Senate from Missouri, was forced by Missouri Secretary of State Robin Carnahan to produce documentation, including his birth certificate and naturalization papers, in order to get on the ballot; something Missouri did not require of Barack Obama. ¿Qué pasa con eso, amigo? ...

Three judges on the 3rd U.S. Circuit Court of Appeals are beginning to review a case that alleges Barack Obama is not eligible to be president - in fact, he may not even be American. The case filed was against Obama, Congress and others, just before Obama was sworn into office. The case has argued, "Under the British Nationality Act of 1948 his father was a British subject/citizen and not a United States citizen and Obama himself was a British subject/citizen at the time Obama was born. "We further contend that Obama has failed to even conclusively prove that he is at least a 'citizen of the United States' under the Fourteenth Amendment as he claims by conclusively proving that he was born in Hawaii," the arguments have claimed. The claims from Apuzzo came in opposition to government demands that the case be dismissed for lack of "standing" on the part of the plaintiffs. ...

Tim Adams, the former Honolulu elections official who alleges Barack Obama was "definitely" not born in Hawaii and that no long-form, hospital-generated birth certificate even exists for the president in the Aloha State now says he's the victim of a vicious smear campaign, threatening his position as an instructor at Western Kentucky University. "There have been attempts by various parties, some bloggers and others to attempt to discredit [my] claims, but none of them has held up to any scrutiny or rebuttal," Tim Adams, the former senior elections clerk in 2008 for the city and county of Honolulu said. "My university was deluged with phone calls and e-mails, many of which were either supportive or neutral, but some folks took it upon themselves to actively try and smear or oust me." ...

The former Honolulu elections clerk who says President Obama was "definitely" not born in Hawaii and has no birth certificate from any hospital in the Aloha State says he's willing to testify in court to those facts. "I was working there, and this is what it was. I'm not a lawyer, just a civil servant. I know what I know. I know what I was told by the hospitals and by my supervisors ... There is no birth certificate," he said. "It's like an open secret. There isn't one. Everyone in the government there knows this." ...

A college professor who worked as a senior elections clerk for the City and County of Honolulu in 2008 is making the stunning claim Barack Obama was definitely not born in Hawaii as the White House maintains, and that a long-form, hospital-generated birth certificate for Obama does not even exist in the Aloha State. He says during the 2008 campaign when the issue of Obama's constitutional eligibility first arose, the elections office was inundated with requests to verify the birthplace of the U.S. senator from Illinois. "I had direct access to the Social Security database, the national crime computer, state driver's license information, international passport information, basically just about anything you can imagine to get someone's identity," Adams explained. "I could look up what bank your home mortgage was in. I was informed by my boss that we did not have a birth record [for Obama]." ...

"Our latest polling shows a majority of Americans -- 55 percent -- want Obama to release all records relating to his childhood and his education, including college records, Harvard Law School papers, passport records, travel records, and other similar documentation," pollster Fritz Wenzel of Wenzel Strategies said. "Asked what should be done should it be found that Obama does not meet the qualifications to be president, 59 percent said he should be removed from office, and 35 percent said all bills signed into law by Obama should be repealed," he said. The poll said when asked about whether Obama's background documentation - the school records, birth records and others - should be released, the 55 percent who said yes included more than 82 percent of the GOP, 55 percent of independents and nearly 28 percent of Democrats. Further, another 17.1 percent of Americans said Obama should release some of his documentation, making it nearly three in four Americans who want the president to unlock the steel door on some or all of his background information. ...

 Nine former employees of Vangent Inc. were charged with accessing Barack Obama's student loan records illegally. They have pleaded not guilty in federal court. Barack Obama's very first act as "President" made it illegal to release any of his records. "Executive Order 13489-Presidential Records," signed by Barack Obama on January 21, 2009, begins as follows: "By the authority vested in me as President by the Constitution and the laws of the United States of America ..." If there is nothing to hide, why hide it? Yet, the very first thing he did as alleged-President was sign an Executive Order that locks all of his records, including his personal ones, away from public view.
