Robert Carlyle Byrd, the longest-serving member of Congress in United States history, who spent much of his career as a conservative Democrat and ended it by fiercely opposing the war in Iraq and questioning the state's powerful coal industry, died Monday. He was 92. Byrd died at 3 a.m. at Inova Fairfax Hospital in Falls Church, Va., according to the statement. Byrd was hospitalized late last week with what was thought to be heat exhaustion and severe dehydration, according to his staff, which did not announce his hospitalization until Sunday afternoon. At that time, doctors described him as "seriously ill." ...

Former Gov. Dolph Briscoe Jr., who presided over Texas during the oil and gas boom years before a stunning upset in 1978, died Sunday, according to his family. He was 87. "He understood the importance of limited government and low taxes as a way to guard individual liberty and encourage the economic growth that creates jobs for families," Republican Gov. Peddling Peril: How The Secret Nuclear Trade Arms America's Enemies

A great deal has been written about Pakistani metallurgist A.Q. Khan and his collaborators, but I have never found an account as detailed as the one in "Peddling Peril: How the Secret Nuclear Trade Arms America's Enemies," by the nuclear armaments expert David Albright. Albright holds master's degrees in physics and mathematics and has taught physics. For five years-between 1992 and 1997-he was part of the International Atomic Energy Agency's Action Team and in that capacity he spent time as a weapons inspector in Iraq. In 1993, he founded the Institute for Science and International Security, a nonprofit research organization based in Washington, D.C., of which he is president. In short, Albright is a perfect person to write a book like this.

 Supreme Court nominee Elena Kagan let some of her personality show through Tuesday as members of the Senate Judiciary Committee poked into every corner of her legal thinking. ...

Ms. Kagan's responses, during a long and sometimes tense day of parrying with members of the Senate Judiciary Committee, were similar to those of Supreme Court nominees past. But unlike her predecessors, Ms. Kagan wrote a 1995 article calling for judicial nominees to be more forthcoming. On Tuesday, minutes into her testimony, she backpedaled, saying she now believed it would be inappropriate even to answer questions that might "provide some kind of hints" about her views on matters of legal controversy. The remark set the stage for a day of hearings in which Ms. Kagan struck a delicate balancing act that proved frustrating to some senators even as the White House declared her "open and forthcoming." Senator Arlen Specter, Democrat of Pennsylvania, repeatedly cut off Ms. Kagan, complaining at one point, "I don't think I'm making too much progress." ...

Some Democratic senators who attended a bipartisan White House meeting Mr. Obama convened to find a consensus on energy policy said there appeared to be support for a proposal to cap greenhouse-gas emissions from electric power utilities only. Most Republicans and some Democrats remain opposed to even that. But Republicans who attended the session said they could support more limited proposals to promote energy efficiency and renewable-energy technology. ...

Whether or not the cap and tax bill will have any effect at all on "climate change" or "energy independence" -- almost certainly not -- the measure will assuredly achieve a major objective of its sponsors. It will dramatically expand government regulation and increase tax revenues. Once that happens, energy sector businesses can be constantly shaken down for political support, and the new tax dollars can be used to hire more unionized government bureaucrats and buy even more votes. ...

The White House says the arrests of 11 people in an alleged Russian spy ring is not a setback to improved U.S.-Russian relations. Spokesman Robert Gibbs said Tuesday that Burger-Meister Barack Obama knew about the alleged spy ring before he hosted Russian President Dmitri Medvedev last week. But Gibbs said Mr. Obama did not raise the issue during their talks. Gibbs said Moscow and Washington have made great progress in the last year-and-a-half resetting relations, and will keep working together on such issues as Iran and North Korea. In Moscow, Prime Minister Vladimir Putin - meeting with former U.S. President Bill Clinton -- said he also believes the scandal will not hurt ties with the United States. He said he hopes that the people who value these relations understand this.

Former Bush administration adviser Karen Hughes said Tuesday that former President Bush would have handled the oil spill in the Gulf of Mexico much better than Barack Obama. The former Bush administration strategist and former head of public diplomacy for the State Department criticized Obama's response as "almost unbelievably passive." "I mean, I remember some of the criticism President Bush got when after two days we couldn't get enough federal assets into Louisiana to rescue people who had been ordered to evacuate but refused to evacuate, that was two or three days," Hughes said. "We're now going on two or three months of an oil spill and where are the resources of the federal government in helping to clean it up?" ...

He's been keeping such a low profile since nearly derailing Barack Obama's campaign for president in 2008 -- is it possible that the controversial Rev. Jeremiah Wright has mellowed? Hardly. During a five-day seminar Wright taught last week in Chicago, he was back at it, claiming that whites and Jews are controlling the flow of worldwide information and oppressing blacks in Israel and America. "White folk done took this country," Wright said. "You're in their home, and they're gonna let you know it." The civil-rights movement, Wright said, was never about racial equality: "It was always about becoming white . . . to master what [they] do." Martin Luther King, he said, was misguided for advocating nonviolence among his people, "born in the oven of America." ...

Down in our nation's capital, the day belongs to a lot of people: To retiring Supreme Court justice John Paul Stevens, who Monday capped his lengthy career on the court; to Elena Kagan, who survived her first day of Senatorial grilling; to Robert Byrd, an institution within the institution, who died on Monday at age 92. But in the mind of some law professors and Supreme Court watchers, the day belonged to Justice Clarence Thomas, for his concurring opinion in McDonald v. Chicago. Justice Thomas boldly went where no justice has gone before: to the arms of the Privileges or Immunities Clause. He wrote: "[T]he text of the Privileges or Immunities Clause . . . command[s] that '[n]o State shall . . . abridge' the rights of United States citizens . . . the Clause establishes a minimum baseline of federal rights, and the constitutional right to keep and bear arms plainly was among them." ...

 The Texas and Arizona governors criticized the Obama administration's border security plans Monday, saying not enough National Guard troops are being deployed to their states. "What we heard wasn't anything we hoped to hear," Arizona Gov. Jan Brewer told reporters after a 90-minute briefing by federal officials sent by President Barack Obama. Texas Gov. Rick Perry, a Republican like Brewer, said the deployment to his state was "insufficient to meet the needs of securing the Texas-Mexico border." Arizona will get 135 million dollars for border security efforts, the Mexican government will get some 310 million in the same plan. ...

Kagan's opening testimony marked the beginning of a marathon high-pressure vetting by the committee, in which members will scrutinize her record. Her remarks also came after the GOP, including the top Republican on the Senate Judiciary Committee, voiced concerns over the 50-year-old solicitor general, telling the panel that her career has been "consumed more by politics than law." Sen. Jeff Sessions, R-Ala., ranking Republican on the panel, said Kagan's record warrants close questioning as the Senate considers her appointment to the nation's highest court. "Ms. Kagan certainly has numerous talents and good qualities, but there are serious concerns about this nomination," he said. The GOP is expected to grill Kagan on hot-button issues from guns to abortion to campaign finance, arguing that she'd bring liberal politics and an anti-military bias to the job of a justice. ...

Gen. Stanley A. McChrystal told the Army that he intends to retire, military officials said, less than a week after President Obama fired him as the commander of U.S. and NATO forces in Afghanistan. The decision wasn't a surprise -- McChrystal was unlikely to have received another appointment after being forced out over derogatory comments he and his staff made to a Rolling Stone magazine reporter about key administration figures, including Vice President Joe Biden. The speed with which he decided to leave the Army, however, underscored the drama of his dismissal. ...

 AND TEXT. Whatever tough questions Petraeus faces from Senators will likely have to do with his level of support for the Obama administration's timetable to begin drawing down troops from Afghanistan in July 2011, and if he intends to maintain McChrystal's tactical directives that emphasize reducing the number of civilian casualties in the battle against the Taliban. Petraeus' support for the 2011 timetable was cast into question by some of his answers before the same committee two weeks ago. ...

What is it with President Obama and artificial deadlines? First he set a deadline for shutting down Guantanamo by January 2010 -- yet the detention center remains open and the New York Times reports that the White House has given up on closing it before Obama's term ends. Instead of learning from that experience, Obama set another misguided deadline -- this time to begin an American withdrawal from Afghanistan by July 2011. Whether the president realizes it or not, he is going to have to abandon that deadline as well -- and the sooner he does so the better. The Guantanamo deadline only cost him some momentary embarrassment; the Afghanistan deadline could cost us a war. ...

The biggest news was that the United States held to the position of the need for additional stimulus, while the other majors all had decided the time had come to tighten their belts. The Obama administration just doesn't get it. But we knew that beforehand, didn't we? ...

Public universities can refuse to recognize student groups that discriminate in their membership, the United States Supreme Court ruled Monday in a case between a University of California law school and a Christian student group that bars those who engage in "unrepentant homosexual conduct" or fail to sign a pledge of faith. A 5-4 majority found that UC's Hastings College of the Law in San Francisco could legally reject a chapter of the Christian Legal Society under the school's "all-comers" anti-discrimination policy that requires recognized student groups to allow any student to join. The recognized groups gain access to campus meeting facilities, e-mail and bulletin board privileges and up to $5,000 in travel funds paid from student activity fees. Christian Legal Society, or CLS, argued that the school violated the group's constitutional right to free speech, expressive association and free exercise of religion when Hastings rejected it in 2004. Neighbors noticed that Cynthia had a slight accent -- Scandinavian, she told them. It seemed like a model upper-middle-class life. Ten alleged members of a "long- term, deep-cover" Russian spy ring whose ultimate goal was to infiltrate U.S. policy-making circles have been arrested, the Justice Department said. The arrests in the New York area and in Boston and Arlington, Virginia, were the result of an investigation by U.S. authorities into the ring, which began operating in the 1990s, according to two criminal complaints unsealed yesterday. The alleged ring included agents posing as American and Canadian citizens, some of them living in the U.S. for more than 20 years, with the goal of becoming "Americanized" and passing intelligence back to the Russian Federation, according to the complaints. ...

Tropical Storm Alex, which is reported to have killed at least 10 people in Nicaragua, Guatemala and El Salvador, is forecast to reach hurricane strength on Tuesday. It is projected to travel well west and south of the spill, which lies about 50 miles off the Louisiana coast, but BP's plans to move a third containment vessel to the site of the leak could be pushed back by about a week by high waves, a company spokesman said on Monday. US government officials estimate that 35,000 to 60,000 barrels of oil are gushing from the blown-out well each day. BP's current containment system can handle up to 28,000 barrels daily. The planned addition would have raised that to 53,000 bpd, BP said. ...

A man who used the Internet site Craigslist to arrange the rape of his former girlfriend in Casper, Wyoming late last year will serve at least 60 years in prison, a district judge ruled Monday. District Judge David Park on Monday sentenced 28-year-old Jebidiah James Stipe, of Twentynine Palms, Calif., to serve 60 years to life on a conviction of aggravated kidnapping. The judge ordered Stipe's sentences on other convictions in the attack to run concurrently. Stipe had faced from 20-years to life following his guilty plea last month to three counts of sexual assault and one count each of aggravated kidnapping and aggravated burglary. ...

Shahram Amiri, a university researcher working for Iran's Atomic Energy Organization, disappeared during a pilgrimage to Saudi Arabia a year ago and Tehran accused Riyadh of handing him over to the United States, which Saudi Arabia has denied. Earlier this month Iranian television showed a first video of a man it said was Amiri. In the footage, Amiri said he had been kidnapped, taken to the United States and tortured. However shortly after that footage, a second video appeared on the Internet, also purporting to be Amiri, in which he said he was actually studying in the United States. ...

Militants detonated a car bomb at a gate to the base in Jalalabad and then tried to storm in using small arms and rocket-propelled grenades provoking a half-hour gun battle. Airport authorities said eight attackers died. A Taliban spokesman who gave his name as Zabiullah Mujahid said the movement had carried out the attack with six suicide attackers. Jalalabad airfield is one of the largest bases in eastern Afghanistan and regularly comes under rocket attack. However, today's ground assault is believed to be the largest attack in some time. ...

Foreign diplomats have got away with a series of serious crimes on British soil, including a threat to kill, sexual assaults and human trafficking. Figures released by ministers have revealed an extraordinary crime spree carried out by embassy workers under the cloak of diplomatic immunity. In the last five years, the diplomats carried out a total of 78 serious crimes, including 54 driving offences. In the most worrying cases, envoys from Saudi Arabia and Sierra Leone were accused of human trafficking, while a Pakistani diplomat was alleged to have made a threat to kill. Diplomats from Nigeria and Jordan were linked to two cases of actual bodily harm. ...

The US Supreme Court on Monday declined to examine whether an Oregon resident who allegedly was sexually molested by a Roman Catholic priest as a teenager in the 1960s can sue the Vatican for his abuse. The move allows the litigation to move forward toward a trial. A federal judge and a federal appeals court had ruled earlier that the lawsuit could go forward. Lawyers for the Vatican, also known as the Holy See, asked the high court to take up the case and dismiss it. They argued that the Vatican could not be held legally responsible for alleged criminal acts undertaken by a priest when those illegal acts were unrelated to his work for the Roman Catholic Church. At issue was whether the Vatican, a foreign sovereign nation, can be forced to pay money damages to a US citizen for the alleged illegal acts of one of its employees. ...

Mr. March, You linked the video of Hillary Clinton having what has been referred to as an 'outburst' on your site, yet, you did not explain the context. You omitted the truth and presented the situation as another crazy Clinton moment. You not only misportrayed the situation, you lost an opportunity to share/address the plight of women who have no rights in their country. I have been a long time reader of your March Report and have shared the Report with many people. I wrote to you addressing the Clinton video and have seen no retraction or explanation. I won't be referring anyone to this page anymore. My belief and trust that you maintain objectivity and research all sides has been permanently altered recently. Consevative or not, you have always seemed to work at being fair and true to journalism. I now am seeing you differently.

This reader has mischaracterized the report. In fact, we went out of way to add clarity to the situation. The copy proved by WMAQ-TV, the televsion station which provide the report through one of our syndicators, said "A Congolese university student seems to presume that Bill Clinton's opinion is more important than the current Secretary of State's." In order to portray the situation accurately, we rewrote the copy to read as follows (emphasis added): "As a result of a translator's error, a Congolese university student appears to presume that Bill Clinton's opinion is more important than the current Secretary of State's. Hillary explodes, and hilarity ensues. Oh, those wacky, wacky Clintons." That was all the information that was available on August 11, 2009, when we ran the story. Witty retort aside, we went out of our way to clarify the report. Further details from the State Department and the White House did not become available until the following day.

Another reader, who wish to be referred to by the nom de plume "Needles," has an unusual take on the Certifi-Gate crisis:

The birthers need to step back and consider the consequences of their actions. If Mr. Obama were to be declared ineligible, there are several possible outcomes. They could remove him from office and install Joe Biden as President. The argument would be made that if Mr. Obama was not eligible to run for President, then the ticket is invalid as well and Joe Biden should not be Vice President. The next person in the order of succession would be Speaker of the House; Nancy Pelosi. Because no eligible candidate received a majority of electoral votes, the selection of the President could be thrown into the House. Speaker Nancy Pelosi, would then be king-maker. The choices are Joe Biden, Nancy Pelosi or someone Nancy Pelosi picks. Maybe it is best to leave the birth certificate matter alone.

Robert Jay March Responds:

Mr. Obama being declared ineligible does not legally invalidate Biden's election, provided he is qualified. Even if it did, the Constitution is too important to ignore; it is all that separates us from tyranny. Regardless of the consequences, if in fact Mr. Obama is ineligible, he must be removed. That said, all we have thus far is the preponderance of evidence leading to a likely conclusion, not conclusive facts. That is why the revelation of the long-form birth certificate is so important.

Finally, a third reader who wish to be referred to by the nom de plume "unihawker," writes:

Dear Mr. March, I was watching TV the other night and they showed a clip of Obama in Kenya during his trip there during the campaign. I am not sure if it was just some Freudian slip or not, but he said as he was waiving to the people greeting him, "Thank you, it is great to be back home". My question was, If he was not born in that country why would he call it home?

Robert Jay March Responds:

Good question, for which I have no answer. If this report is correct, it is yet another contribution to the preponderance of evidence that implies Mr. Obama is ineligible. A copy of the long form birth certificate would cost Mr. Obama $12; thus far he has spent $1.3 Million to avoid producing it. As in any investigation, follow the money: in this case, what money is being spent on to conceal.
