Robert Carlyle Byrd, the longest-serving member of Congress in United States history, who spent much of his career as a conservative Democrat and ended it by fiercely opposing the war in Iraq and questioning the state's powerful coal industry, died Monday. He was 92. Byrd died at 3 a.m. at Inova Fairfax Hospital in Falls Church, Va., according to the statement. Byrd was hospitalized late last week with what was thought to be heat exhaustion and severe dehydration, according to his staff, which did not announce his hospitalization until Sunday afternoon. At that time, doctors described him as "seriously ill." ...

Former Gov. Dolph Briscoe Jr., who presided over Texas during the oil and gas boom years before a stunning upset in 1978, died Sunday, according to his family. He was 87. Briscoe had been hospitalized in poor health in January and had returned home only recently, family spokeswoman Ann Arnold said. "He understood the importance of limited government and low taxes as a way to guard individual liberty and encourage the economic growth that creates jobs for families," Republican Gov. Rick Perry said in a statement following Briscoe's death. "I will miss his friendship and wise counsel." ...

 Reclaiming The Jeffersonian Tradition Of Nullification

Under today's constitutional law, the "Federal" (really now national) Government can do anything it wants. The speaker of the House literally laughs at the implication that it cannot. For anyone who knows history and loves liberty, this is a worrisome situation. What to do? In "Nullification: How to Resist Federal Tyranny in the 21st Century," Thomas E. Woods, Jr.'s answer is to dust off the Jeffersonian tradition of nullification. Nullification lays out the argument for nullification's constitutionality, describes historic and contemporary instances in which the doctrine has been and is being employed, and advocates that it be used more widely today. Finally, in a very useful appendix, Woods provides some of the classic nullification documents from days gone by. The appendix serves both to arm the reader with pro-nullification arguments and to illustrate the variety of circumstances to which it has been applied.

A Mind-Changing Page

Sometimes you can read a book that will change your mind on some fundamental issue. Rarely, however, is there just one page that can undermine or destroy a widely-held belief. But there is such a page-- page 77 of the book "Out of Work" by Richard Vedder and Lowell Gallaway. What is on that one page in "Out of Work: Unemployment and Government in Twentieth-Century America" that could change people's minds? Just a simple table, giving unemployment rates for every month during the entire decade of the 1930s. Those who think that the stock market crash in October 1929 is what caused the huge unemployment rates of the 1930s will have a hard time reconciling that belief with the data in that table.

The Struggle For Tibet

After nearly half a century of Chine occupation of Tibet, riots on an unprecedented scale occurred not only in the Tibetan Administrative Region (TAR), but also in parts of China with substantial Tibetan populations. Prior to what has come to be known as the March Incident of 2008, Tibetan protests had largely been limited to areas within TAR proper. How can we explain the spontaneous -- and violent -- uprising that shocked the world months before the Beijing Olympics and invited an ironfisted crackdown by the Chinese authorities? The answer is the culminating The Struggle for Tibet, a collection of articles written by Tibetan academic Tsering Shakya and the Chinese intellectual Wang Lixiong. In what often reads like a dialogue between the two authors, the book explores the question of Tibetan identity, religion, assimilation and resistance from the perspective of Tibetans.

Peddling Peril: How The Secret Nuclear Trade Arms America's Enemies

A great deal has been written about Pakistani metallurgist A.Q. Khan and his collaborators, but I have never found an account as detailed as the one in "Peddling Peril: How the Secret Nuclear Trade Arms America's Enemies," by the nuclear armaments expert David Albright. Albright holds master's degrees in physics and mathematics and has taught physics. For five years-between 1992 and 1997-he was part of the International Atomic Energy Agency's Action Team and in that capacity he spent time as a weapons inspector in Iraq. In 1993, he founded the Institute for Science and International Security, a nonprofit research organization based in Washington, D.C., of which he is president. In short, Albright is a perfect person to write a book like this.

In Arizona, 6,100 of the state's 41,000 prison inmates are here illegally, according to Tasya Peterson, a spokesman for Gov. Jan Brewer. The last time the feds kicked in to help, she said, was in 2008. According to figures provided by the state, it cost Arizona $120.4 million to incarcerate illegal immigrants that year, not counting the expense of arrest and prosecution. The feds picked up about 10 percent of the tab: $12.8 million, leaving Arizona taxpayers to shoulder the rest of a burden that exists because the federal government can't -- or won't -- do its job. Brewer last week informed Obama that Arizona is now shelling out $150 million a year to incarcerate illegal immigrants. Instead of our own government suing Arizona this week -- what, five lawsuits over SB 1070 isn't enough? -- perhaps the Justice Department might like to conserve its resources and pay its bills which, in Arizona, are long, long past due. ...

YEST Oiled Dolphin Found In Florida Died Shortly After Help Arrived

Video The tide isn't just washing the oil over the beach. Wildlife is starting to feel the impact as well. An oiled dolphin was found beached on the shore. "It had beached itself. Its sides were covered in a quarter inch of oil. We started splashing water, scraped oil off it sides and off its eyes," said Christy Travis, who found the dolphin. Help came immediately from the Emerald Coast Wildlife Refuge, a non-profit organization, and they were able to stabilize the young female. Sadly, she died shortly after. What's worse, is she may not be the last. "It was very sad, it would make you cry. It was crying. There was pod of dolphins just off surf and they were jumping out of water and they were making noise," said Travis. This is the first report of a dolphin found covered in oil on the Florida coastline. ...

A most important skill for any investor, but especially for a real estate investor, is how to evaluate a transaction. Quickly differentiating what may be a good deal from what is probably a marginal or bad deal, is a necessary skill. My philosophy is to try to give the seller what they want -- but to give it in a manner that makes sense for me. Many might think that an investor is simply looking out for his own interest. Of course, protecting one's self is paramount. However, people are not stupid. If one party tries to take advantage of the other, usually no deal is struck and no one wins.

Fico -- who has led an academic commission to study classified documents relating to that era -- said Brazil's government suddenly made a large amount of classified documents available to the public. That resulted in an avalanche of military documents that have now been jammed into every corner of the government archives building, including bathrooms. As court orders continue to force military jurisdictions throughout Brazil to send in their documents, the building cannot handle the load, Fico said. Court Says It's Okay To Remove Content From The Public Domain And Put It Back Under Copyright

You may recall that last year, a district court made a very important ruling on what appeared to be a minor part of copyright law. The "Golan" case asked a simple question: once something is officially in the public domain, can Congress pull it out and put it back under copyright? The situation came about because of (yet another) trade agreement that pulled certain foreign works out of the public domain. A district court had initially said that this move did not violate the law, but the appeals court sent it back, saying that the lower court had not analyzed the First Amendment issue, and whether this was a case where the inherent conflict between the First Amendment and copyright law went too far to the side of copyright by violating the "traditional contours of copyright law." Getting a second crack at this, the district court got it right -- and was the first court to point out that massively expanded copyright law can, in fact, violate the First Amendment. ...

Liar's Poker and Obama's 'Tell'

What did Obama know and when did he know it? We can expect to hear that question repeated over and over again, and this time without the news blackout imposed by all the networks, including Fox News, on the questions about Obama's birth certificate

Barack Obama had promised transparency in governance, but has proved himself to be just another practitioner of deep-dish Chicago politics: cheesy, with a thick crust. His credibility had apparently hit bottom with his handling of the BP oil spill, coupled with the revelation that Obama was the largest recipient of campaign contributions from BP, but this latest revelation has pushed it into the sub-basement. When we first inaugurated the Obamalot section of MarchReport.com on January 27, 2009, with a logo containing the phrase "Transparency Since 2009 (Except When We're Opaque)," we got the expected protests that proclaimed the new messiah would be open about everything. Of course, we knew better, having already seen his duplicity regarding his legal qualifications to serve as President. It was not exactly a stretch to visualize how he would conduct himself in office, and he has lived down to our expectations.

On February 18, 2010, Rep. Joe Sestak (D-PA) revealed on Comcast's Larry Kane Show that the White House had offered him a job to induce him to withdraw from the primary race against turncoat former Republican Senator Arlen Specter, who had switched parties in order to assure his re-election. It's interesting to note that the story, which is a public relations nightmare for Obama, was broken on a Comcast cable show, in that it is Comcast that is buying NBC (including MSNBC). Does this presage a change of direction for MSNBC, which to date has been little more than a public relations service for Obama?

It was rumored that Sestak, a retired naval Admiral, had been offered the position of Secretary of the Navy in violation of Title 18 USC §211, "Acceptance or solicitation to obtain appointive public office," Title 18 USC §595 "Interference by administrative employees of Federal, State, or Territorial Governments," and Title 18 USC § 600 "Promise of employment or other benefit for political activity." Only the President (or, in this case, the guy who plays one on T.V.) could have authorized such an offer, since it is he who makes such appointments. This is an impeachable offense, being a "high crime or misdemeanor," which at the time of the drafting of the Constitution, meant a crime or misdemeanor that the offender would ordinarily have been spared the consequences of, by virtue of his high position.

On April 21, 2010, Rep. Darrell Issa of California, the top ranking Republican Member of the House Oversight and Government Reform Committee, sent a letter to Attorney General Eric Holder requesting the appointment of a Special Prosecutor to investigate the Sestak bribe attempt. To date, there has been no such appointment.

On the May 23 edition of Face The Nation, Sestak again confirmed the job offer, but would not give any details.

The range of human experiences is quite limited, and the same events keep repeating themselves over and over again, with a different cast of characters, much like a Hollywood re-make. The Sestak affair is eerily reminiscent of a Gus Van Sant re-make of the Watergate crisis. Much like Van Sant's color remake of Psycho, it's the same script replayed with lesser actors. Just as during the Nixon administration, and several times since, The White House has investigated itself, assuring us that nothing improper has happened; and, just as happened during the Nixon years, very few are buying it. Clearly, a special prosecutor or independent counsel needs to be appointed.

Modern-day reporters are inherently lazy, being closer to game-show hosts than the ink-stained wretches of yore, and like stories that present themselves already written; no wearing out shoe leather, or even using up cell-phone minutes nowadays. No press-pass sticking up out of their well-worn hat brim: that might muss their well-coifed hair. Regardless of how much they have covered up for Obama thus far, there is now blood in the water, and if it bleeds, it leads.

They started by quizzing his press secretary, Robert Gibbs, who hemmed and hawed, being very careful to say nothing that could get him indicted as a co-conspirator. Then they asked Obama, who did his best impression of Ralph Kramden saying, "Hamena, Hamena, Hamena." Watch the video in the immediately preceding link, and take note of Obama's body language. Stiff as a board, saucer eyed, unblinkingly staring at Alice Kramden ... I mean, Major Garrett.

At least Richard Nixon had the guts to look right into the camera and lie. Just as Obama did when he fumbled the Inauguration oath...



... his "Tell" betrays him. Somewhere inside him, there is the awareness that he is doing wrong. Somewhere inside him, there is the desire to get caught, and that force is struggling to find it's way to the surface, to burst forth as if from John Hurt's chest.

The song "The Gambler," popularized by Kenny Rogers, contains these lyrics: "Son, I've made my life out of readin' people's faces, / And knowin' what their cards were by the way they held their eyes. / So if you don't mind my sayin', I can see you're out of aces."

You got to know when to hold 'em, and know when to fold em. Hopefully, this time the press, which has horribly betrayed us thus far, will force him to show his hole card and surrender his chips. That said, you never count your money when you're sittin' at the table.

For the prior 150 years, the Supreme Court interpreted the Commerce clause to prevent unfair competition between the States. For the past 73 years, Congress has viewed the precedent from the FDR court as Constitutional authority to regulate whatever they please. ...

Pacific Islands Not Sinking From Global Warming

In a forthcoming issue of the journal Global and Planetary Change, researchers from the University of Auckland in New Zealand and the Pacific Islands Applied Geoscience Commission in Fiji documented changes in 27 vulnerable, low-lying reef islands in the Central Pacific. Using aerial photographs taken as early as 1944, the areas were carefully mapped and compared with modern satellite images. It turns out that the islands did, in fact, change over time, but they are hardly sinking. Overall, 20 grew or remained stable. The island of Funamanu, for example, expanded from 7.4 acres to 9.5 acres in size -- a 28 percent growth. Only seven islands shrunk, with the biggest percentage change occurring on Tengasu, which dropped from a tiny 1.7 acres to 1.5 acres -- a diminishment of 9,670 square feet, the size of Mr. Gore's Tennessee mansion. ...

Global-Warming Alarmism Dying A Slow Death

The rapid loss of public credibility over all the errors has also accompanied numerous calls by prominent voices for official inquiries and even criminal investigations. Several universities involved have already launched reviews. And even previous IPCC chief Professor Robert Watson, for example, is calling for a probe to investigate "warming bias" by the UN panel. "The mistakes all appear to have gone in the direction of making it seem like climate change is more serious by overstating the impact. That is worrying," he told the U.K. Times Online. "The IPCC needs to look at this trend in the errors and ask why it happened." The UN will indeed launch an "independent" inquiry, but critics generally expect a coverup. U.S. Senator James Inhofe (R-Okla.) went further, proposing criminal investigations to determine if alarmists violated any laws. A Senate report produced for Inhofe's Environment and Public Works Committee concluded that, among other problems, "scientists involved in the CRU controversy violated fundamental ethical principles governing taxpayer-funded research and, in some cases, may have violated federal laws." Similarly, British authorities were investigating possible criminal activity by Climategate scientists who refused to provide documents and data under lawful Freedom of Information requests. The scientists may reportedly escape prosecution under the FOI law because of a six-month statute of limitations. ...

    A reader who wishes to remain anonymous sent in this criticism:

    Mr. March, You linked the video of Hillary Clinton having what has been referred to as an 'outburst' on your site, yet, you did not explain the context. You omitted the truth and presented the situation as another crazy Clinton moment. You not only misportrayed the situation, you lost an opportunity to share/address the plight of women who have no rights in their country. I have been a long time reader of your March Report and have shared the Report with many people. I wrote to you addressing the Clinton video and have seen no retraction or explanation. I won't be referring anyone to this page anymore. My belief and trust that you maintain objectivity and research all sides has been permanently altered recently. Consevative or not, you have always seemed to work at being fair and true to journalism. I now am seeing you differently.

    Robert Jay March Responds:

    This reader has mischaracterized the report. In fact, we went out of way to add clarity to the situation. The copy proved by WMAQ-TV, the televsion station which provide the report through one of our syndicators, said "A Congolese university student seems to presume that Bill Clinton's opinion is more important than the current Secretary of State's." In order to portray the situation accurately, we rewrote the copy to read as follows (emphasis added): "As a result of a translator's error, a Congolese university student appears to presume that Bill Clinton's opinion is more important than the current Secretary of State's. Hillary explodes, and hilarity ensues. Oh, those wacky, wacky Clintons." That was all the information that was available on August 11, 2009, when we ran the story. Witty retort aside, we went out of our way to clarify the report. Further details from the State Department and the White House did not become available until the following day.

    Another reader, who wish to be referred to by the nom de plume "Needles," has an unusual take on the Certifi-Gate crisis:

    The birthers need to step back and consider the consequences of their actions. If Mr. Obama were to be declared ineligible, there are several possible outcomes. They could remove him from office and install Joe Biden as President. The argument would be made that if Mr. Obama was not eligible to run for President, then the ticket is invalid as well and Joe Biden should not be Vice President. The next person in the order of succession would be Speaker of the House; Nancy Pelosi. Because no eligible candidate received a majority of electoral votes, the selection of the President could be thrown into the House. Speaker Nancy Pelosi, would then be king-maker. The choices are Joe Biden, Nancy Pelosi or someone Nancy Pelosi picks. Maybe it is best to leave the birth certificate matter alone.

    Robert Jay March Responds:

    Mr. Obama being declared ineligible does not legally invalidate Biden's election, provided he is qualified. Even if it did, the Constitution is too important to ignore; it is all that separates us from tyranny. Regardless of the consequences, if in fact Mr. Obama is ineligible, he must be removed. That said, all we have thus far is the preponderance of evidence leading to a likely conclusion, not conclusive facts. That is why the revelation of the long-form birth certificate is so important.

    Finally, a third reader who wish to be referred to by the nom de plume "unihawker," writes:

    Dear Mr. March, I was watching TV the other night and they showed a clip of Obama in Kenya during his trip there during the campaign. I am not sure if it was just some Freudian slip or not, but he said as he was waiving to the people greeting him, "Thank you, it is great to be back home". My question was, If he was not born in that country why would he call it home?

    Robert Jay March Responds:

    Good question, for which I have no answer. If this report is correct, it is yet another contribution to the preponderance of evidence that implies Mr. Obama is ineligible. A copy of the long form birth certificate would cost Mr. Obama $12; thus far he has spent $1.3 Million to avoid producing it. As in any investigation, follow the money: in this case, what money is being spent on to conceal.
